C. That the proposed use complies with applicable <br />sections of the Zoning Chapter. <br />NOW, THEREFORE, THE PLANNING COMMISSION RESOLVES AS FOLLOWS: <br />Section 1. The Planning Commission approves UP-76-28 subject <br />to the following conditions: <br />1. That the area shown for the storage and sales of <br />landscape materials be utilized solely for <br />materials which are directly related to land- <br />scaping activities and that no materials intended <br />for the construction of dwellings, commercial or <br />industrial structures, accessory buildings, <br />swimming pools, screened porches, etc., be <br />stored or sold in this area. <br />2. That approval of UP-76-28 constitutes only approval <br />of the site plan Exhibit A, dated November 6, 1976, <br />on file with the Planning Department; that any <br />change to the site plan shall require City approval; <br />and that any new structures built on the site <br />be submitted to the City for design review approval <br />prior to construction. <br />3. That all wood stored at the front of the Casa <br />Verde building and all materials now stacked <br />outside of the cyclone fence on the south side <br />of the nursery, be moved inside of the fence <br />area immediately after construction of the <br />front fence. <br />4. That except for the sale of firewood, all <br />activities taking place on the subject site shall <br />be directly related to nursery and landscape <br />design and maintenance and that the only equip- <br />ment which shall be rented on the property shall <br />be implements needed for those two activities. <br />5. That the road being proposed to be constructed <br />along the south side of the landscape materials <br />area be of all-weather construction and wide <br />enough that fire apparatus will have access to <br />this area for fire suppression. <br />6. That because the proposed development will <br />increase traffic on Sunol Boulevard and place <br />an additional burden on the street which requires <br />the construction of street improvements, Casa <br />Verde Nursery shall install street improvements, <br />including but not limited to, curb, gutter, <br />sidewalk paving, street lights, and underground <br />utilities along the full frontage of the develop- <br />ment. These improvements are to be designed by <br />a registered civil engineer. Casa Verde Nursery <br />may install these improvements now or enter into <br />an agreement for the deferral of construction of <br />the improvements to a future date. Casa Verde <br />Nursery shall indicate which of the above options <br />they desire prior to the issuance of a building <br />permit. <br />7. That a building permit survey and site development <br />plan per Ordinance No. 387 be submitted to the <br />Director of Engineering Services subsequent to <br />-2- <br />
