C. That because of the conditions attached, the <br />proposed conditional use will comply with each of <br />the applicable provisions of this chapter. <br />SNOW, THEREFORE, THE PLANNING COMMISSION DOES RESOLVE AS FOLLOWS: <br />Section 1. The Planning Commission approves UP-76-31, subject <br />to the following conditions: <br />1. That the developme <br />to the site plans, <br />Exhibit A, on file <br />except as modified <br />2 of Design Review <br />dated November 10, <br />zt be substantially similar <br />elevations and landscape plan, <br />with the Planning Department <br />by conditions number 1 and <br />Board Resolution No. R-76-36 <br />1976. <br />2. That approval of this case is conditioned upon <br />the approval of case Z-76-204 and all conditions <br />which may be attached to that case by the Design <br />Review Board. <br />3. That no truck deliveries be made to any business <br />on any portion of the 5.4 acre subject site between <br />the hours of 8 p.m. and 8 a.m. <br />4. That all buildings on the site be equipped with <br />alarm systems, the types to be approved by the <br />police division and that the system shall be <br />installed prior to final building inspection. <br />5. That any damage done to street improvements now <br />existing or done during construction on the sub- <br />ject site be repaired at full expense to the <br />developer. <br />6. That the developer dedicate the additional right- <br />of-way required along the Hopyard Road frontage <br />of the subject property to the city (approximately <br />24 ft. x 275 ft.). <br />7. That the developer dedicate to the city, an ease- <br />ment for public utility and water well purposes <br />over the land presently occupied by the City of <br />Pleasanton well number 7 and a suitable access <br />easement between the well site and a dedicated <br />public street; configuration and size of well <br />site and access dedications to be determined by <br />the city and developer's engineer pursuant to <br />the requirements of the city for use and mainte- <br />nance of and access to the city well; no use <br />inconsistent with the city's existing easement or <br />fee rights may be commenced unless and until <br />dedications acceptable to the City Engineer have <br />been granted to the City and recorded in a form <br />acceptable to the City Attorney securing continued <br />use of and access to City of Pleasanton Well No. 7. <br />8. That the developer dedicate a 15 ft. p.s.e. for <br />water line purposes between the well site and <br />the southeast corner of the development. The <br />precise location of this easement is to be deter- <br />mined by the City and the developer's engineer. <br />9. That the developer dedicate to the City a 15 ft. <br />p.s.e. for the existing water transmission main <br />between the well site and Hopyard Road. <br />-2- <br />
