3. ELIGIBLE EQUIPMENT <br /> <br /> A. Equipment originally supplied by Multisonics is eligible for <br /> <br />inclusion under this Agreement subject to acceptance after inspection <br />by Multisonics. The City may order any labor and parts required to <br />place the equipment in acceptable operating condition at Multisonics' <br />prevailing rates. The parties agree that the equipment listed in <br />Annex I is in acceptable operating condition as of the date of this <br />Agreement. <br /> <br /> B. Additional equipment acquired by the City during the <br />Agreement period may be incorporated into this Agreement by amendment <br />to Annex I hereof. The expiration of the service coverage period for <br />such equipment shall coincide with the original Agreement period end. <br /> <br />4. EQUIPMENT ENVIRONMENT <br /> <br /> A. The City shall provide Multisonics advance written notice of <br />intent to move the equipment covered under this Agreement from the <br />location specified in Annex I hereof. Maintenance service as to such <br />equipment shall be suspended on the day that the equipment is <br />dismantled in preparation for shipment, and reinstated on the day <br />installation and checkout procedures necessary to place the system in <br />an acceptable operating condition are complete. <br /> <br /> B. On any relocation, upon City request, Multisonics personnel <br />will supervise dismantling of the equipment and reinstall and <br />checkout the equipment at the new location, billable at Multisonics' <br />prevailing labor rates. Multisonics shall not be responsible for any <br />equipment damage incurred during relocation, and repair of such <br />damage is excluded from the terms of the Agreement. <br /> <br /> - 6 - <br /> <br /> <br />
