SCOPE OF SERVICES <br />Task 1. Permitting Services, USACE, CDFG, RWQCB and USFWS <br />Mosaic will coordinate with the USACE, CDFG, RWQCB and USFWS on permit terms and <br />conditions for the Bernal Bridge project. Updated permit applications and project descriptions were <br />submitted to the agencies in December 2006, with mitigation proposed for on-site locations <br />upstream and downstream of the Bernal Bridge. A revised conceptual mitigation plan for the <br />Mission Creek site was submitted to the USACE, CDFG and RWQCB on June 28, 2007, after plans <br />to use the PG&E site for wetland and riparian mitigation were abandoned. <br />Mosaic will describe the impacts to wetlands and waters of the U.S. and state associated with <br />construction of the Mission Creek mitigation site in forthcoming correspondence to the agencies. <br />We will also negotiate an agreement with the USACE, CDFG and RWQCB to ensure that the <br />excess mitigation at the Mission Creek site will be credited towards a future City of Pleasanton <br />project. <br />The USFWS appended the Bernal Bridge project to the programmatic consultation for red-legged <br />frogs in their Biological Opinion (BO) dated April 10, 2007. Since the minimization measures in the <br />BO included on-site wetland mitigation that is not possible without the PG&E site, we will contact <br />USFWS staff to seek a revised BO that allows the purchase of credit at the Ohlone Conservation <br />Bank. Based on direction from CDFG (Janice Gan memo of October 15, 2007) and our research on <br />the proximity ofred-legged frog occurrences to the Mission Creek mitigation site, we have assumed <br />that neither the Mission Creek mitigation site or the restoration adjacent to the Bernal Bridge will be <br />sufficient to meet the USFWS requirements for CRF habitat mitigation. We therefore suggest that <br />the City purchase red-legged frog credit at the Ohlone Conservation Bank, and have included time <br />to negotiate agreement with this approach with the USFWS, and a purchase agreement with the <br />Ohlone Bank. We have not included any services related to the design of offsite red-legged frog <br />habitat in this proposal. <br />These services will be provided on a time and materials basis, and if additional time is required to <br />secure permits for the bridge, we will request budget augmentation. <br />Task 2. Conceptual Wetland and Riparian Mitigation Plan for Mission Creek Site (Complete) <br />Mosaic and Balance prepared a conceptual wetland and riparian mitigation plan for the Mission <br />Creek site, which was presented to the USACE, CDFG and RWQCB on June 28, 2007. This <br />conceptual mitigation plan, which proposed the creation of one acre of perennial wetland habitat <br />supported by low flows from Mission Creek and surrounded by riparian plantings was accepted by <br />the agencies as appropriate for Bernal Bridge, with the excess habitat creation to be credited to a <br />single future City of Pleasanton project. Services provided under this task have been completed. <br />Task 3. Wetland Delineation <br />We will conduct a wetland delineation of the Mission Creek mitigation site. The study area will <br />include the reach of Mission Creek to the confluence with Sycamore/Fairgrounds Creek. The <br />delineation will be submitted to the USACE for verification. The delineation is needed to define the <br />boundaries of existing waters of the U.S. and to allow us to determine the area of impact associated <br />City of Pleasanton/proposal7rev2 <br />
