the area described in Section 2.1 shall not include the <br />replacement or repair of street lighting electroliers unless <br />ownership of said electroliers is conveyed to CSS #112 or to the <br />City. <br />2.3 Term of Maintenance Obligations. The obligations of CSS <br />#112 under Section 2.2 shall commence upon the later of (i) the <br />date of this agreement, or (ii) the date upon which the City <br />Council of the City accepts ownership of the street improvements <br />and other public improvements under construction and shall <br />continue throughout the term of this agreement, unless terminated <br />as provided in Section 5.3. <br />ARTICLE 3 <br />MAIN'T~ENANCE OF BUS SHELTERS <br />3.I Bus Shelters. CSS #112 shall at its sole expense clean, <br />maintain, repair, and replace, where necessary, all bus shelters <br />designated on Exhibit "D", attached hereto and made a part hereof <br />and remove trash from trash receptacles at such bus shelters. <br />Cleaning and trash removal shall be done as frequently as <br />reasonably necessary to maintain the bus shelters in a sightly <br />condition, provided that trash removal shall be done at least <br />weekly. <br />3.2 Structures. CSS #112 shall at its sole expense <br />maintain, repair, and replace, where necessary, walls, and <br />bollards located in the areas described in Sections 1.1.1 and <br />1.1.2. <br />- 5 - <br />
