repair, and replace where necessary any sidewalks located in the <br />areas described in Section 1.1, such maintenance to include <br />removal of graffiti. <br />1.3 Term of Maintenance Obligations. Except as provided <br />below, the obligations of CSS #112 under Section 1.2 with respect <br />to the areas described in Sections 1.1.1 through 1.1.3, <br />inclusive, shall commence upon the later of (i) the date of this <br />agreement, or (ii) the date upon which the City Council of the <br />City accepts ownership of the street improvements and/or other <br />public improvements under construction in those areas and shall <br />continue throughout the term of this agreement, unless terminated <br />as provided in Section 5.3. <br />ARTICLE 2 ~ ~ <br />MAINTENANCE OF STREET LIGHTING <br />2.1 Areas for Street Lighting Maintenance. CSS #112 shall <br />maintain all street lighting within the following area: <br />Rosewood Drive. Rosewood Drive from Santa Rita Road to <br />Trammell Crow's Northwestern Property Line. <br />2.2 Maintenance Requirements. CSS #112 shall at its sole <br />expense maintain all street lighting within the areas described <br />in Section 2.1. Maintenance shall include the payment of all <br />charges for electrical usage, all cost of ownership charges, if <br />any, and the care of all street lighting electroliers and bulbs, <br />including repair and replacement where necessary; provided that <br />the obligations of CSS #112 under this section with respect to <br />- 4 - <br />
