Pathways <br />shall be maintained, repaired, and replaced where necessary. <br />Association°s maintenance obligations shall not include <br />providing security police to patrol the Recreation Easement. <br /> <br /> ARTICLE III <br /> COOPERATION <br /> <br /> City shall utilize the Recreation Easement in such a <br />manner that will neither hinder nor impede Bernal's or <br /> <br />Association's use and enjoyment of the Property and any <br />improvements thereon. City further agrees to exercise <br /> <br />reasonable care and to avoid damage to the Landscaping, <br />Property and other improvements that may at any time be located <br />thereon. <br /> <br /> ARTICLE IV <br /> <br /> INDEMNIFICATION <br /> <br /> 4.1 Bernal. Bernal shall indemnify and hold City, <br />its officers, directors, commissioners, council members, <br />employees, successors and assigns harmless from and against any <br />and all claims, damages, liabilities, causes of action, <br />demands, loss, cost and expenses, including reasonable <br />attorneys' fees and court costs arising out of or in any way <br /> <br /> -5- <br /> <br /> <br />
