Association shall indemnify and <br />hold City, its officers, directors, commissioners, council <br />members, employees, successors and assigns, harmless from and <br />against any and all claims, damages, liabilities, causes of <br />action, demands, loss, cost and expenses, including reasonable <br />attorneys' fees and court costs, arising out of or in any way <br />connected with Association's negligence in connection with the <br />use and maintenance of the Landscaping by Association, its <br />contractors, employees, or agents. <br /> <br /> 4.3 City. City shall indemnify and hold Bernal and <br />the Association, their officers, directors, employees, <br />successors and assigns, harmless from and against any and all <br />claims, damages, liabilities, causes of action, demands, loss, <br />cost and expenses, including reasonable attorneys' fees and <br />court costs, arising out of or in any way connected with City's <br />negligence in connection with the use of the Recreation <br />Easement by City, its contractors, employees, or agents. <br /> <br /> ARTICLE V <br /> INSURANCE <br /> <br /> Except as otherwise provided hereunder, Association <br />and City each agree that they shall, at their own expense, <br />maintain in force a policy or policies of insurance written by <br />one or more responsible insurance carriers licensed to do <br /> <br /> -6- <br /> <br /> <br />
