reasonable care, are not deemed by the City of Pleasanton to be a <br />nuisance." <br />b. A disclosure stating that the City of Pleasanton or the GHAD owns the open <br />space area surrounding Lots 1 through 51, that the open space area will be <br />used by the public, and that the buyer recognizes that the activities that take <br />place in the open space area may result in noise, odors, dust, or other <br />conditions that may affect the lots covered by this PUD Development Plan. <br />c. A disclosure indicating the presence of the subdrains and cleanouts and that <br />it is the responsibility of the homeowner to relocate the subdrains if <br />encountered during the excavation of a pool or other subsurface structure. <br />Any relocated subdrains shall be mapped and submitted to the City for review <br />and approval prior to relocation to determine the effect, if any, on site stability. <br />The City may also refer such request to the GHAD for review and approval. <br />d. A disclosure indicating that the sanitary sewer gravity main, the sanitary force <br />main, and pump stations, if required, serving Lots 27 through 36 will be <br />private utilities and maintained by the individual property owners or the HOA <br />e. A disclosure that the individual sanitary sewer ejector pumps and force mains <br />serving Lots 10, 26 and 51 are private and shall be maintained by the <br />individual property owners. Other lots may be required by the City Engineer <br />to provide such infrastructure and shall be added to the disclosure should it <br />be discovered through engineering design. <br />f. A disclosure that the storm drain system not located within a public street is <br />private and maintained by an HOA or, where applicable, by the private lot <br />owner. <br />g. The following statement, to be included in the CC&R's and in the notice to <br />prospective lot purchasers, that: <br />"You are hereby advised that this property is surrounded by land zoned <br />and/or used for the day and night-time activity relating to the grazing <br />and keeping of livestock. Some of the impacts associated with this use <br />include, but are not limited to, noise, odor, dust, chemicals, refuse, <br />waste, unsightliness, use of agricultural equipment, and traffic. <br />Permitted agricultural pursuits conducted in accordance with good <br />practice and maintenance are not deemed by the City of Pleasanton to <br />be a nuisance." <br />h. The following statement, to be included in the CC&R's and in the notice to <br />prospective lot purchasers that: <br />"You are hereby advised that this property is surrounded by open <br />space land zoned and/or used for the day-time activity relating to local <br />and regional public trails and park/trail staging areas.
