noise, odor, dust, refuse, and bicyclist/pedestrian/ equestrian traffic. <br />These pursuits conducted in accordance with good practice and <br />reasonable care, are not deemed by the City of Pleasanton to be a <br />nuisance." <br />i. A disclosure stating that there are flights to and from the Livermore Airport, <br />and that the buyer recognizes that the flights may result in noise and vibration <br />that may affect the lots covered by this PUD Development Plan. <br />i. A disclosure stating that none of the properties of the Oak Grove <br />development are covered by solar access easements for photovoltaic panels <br />and/or similar equipment, and that the proposed location/existence of <br />photovoltaic panels, etc., on adjacent properties shall not be factored into the <br />City's review/approval of primary and accessory structures including height <br />and location or new/existing landscaping including plant species, height, and <br />location. <br />17. Wording for these disclosures and statements shall be submitted to the City <br />Attorney for review and approval prior to final subdivision map approval by the <br />City Council. <br />18. Nothing shall prohibit the inclusion of other lot numbers not described above due <br />to the development of engineered construction drawings. <br />19. A copy of the CC&R's shall be maintained along with the development plan and <br />the conditions of approval at the future model home/sales trailer. <br />Construction Mitigation Measures <br />20. All subdivision improvements and site improvements and house construction <br />activities, including the delivery of construction materials, labor, heavy <br />equipment, supplies, etc. and shall be limited to the hours from 8:00 a.m. to <br />5:00 p.m., Monday through Friday. The Planning Director may authorize on a <br />case-by-case basis alternate construction hours for specific activities including <br />concrete work, framing, asphalt work, etc. The developer shall provide notice <br />24 hours in advance of modified construction times to the neighbors as <br />determined by the Planning Director. A modified version of this condition shall <br />appear in the design guidelines. (Mitigation Measure J-1 of the FEIR.) <br />21. During the construction of the subdivision improvements, the project developer <br />shall fund the cost of providing a crossing guard at the intersection of Hearst <br />Drive and Concord Street during the regular times that children are walking to <br />and from school. . <br />22. To mitigate the potential construction noise impacts to the surrounding properties <br />adjoining the north and west sides of the Oak Grove property, the project <br />developer shall prepare a Construction Best Management Plan (CBMP) for the <br />Page 7 of 39 <br />
