and/or improvement plans covering this development and/or the individual <br />building sites. These same requirements shall apply to the individual home <br />building sites and shall be added to the design guidelines covering this <br />development. <br />Homeowners Association and Geologic Hazard Abatement District <br />12. A Homeowners Association (HOA) and/or a Geologic Hazard Abatement District <br />(GRAD) shall be responsible for the maintenance of the wildland fire and buffer <br />areas on designated sections of the open space area, bio-detention ponds, <br />landscape buffer and tree reforestation areas on the north and west sides of the <br />development. The HOA and/or GRAD responsibilities shall be determined with <br />the first final subdivision map and shall be carried through to all subsequent final <br />map approvals. The HOA's maintenance responsibilities shall be described in <br />the CC&R's. <br />13. The open space area may be dedicated to the GRAD, in which the Pleasanton <br />City Council is the Board of Directors, in lieu of the City. If that occurs, in addition <br />to the above responsibilities, the GRAD shall be also be responsible for the <br />grazing management plan and the mitigation and monitoring plan for the open <br />space area. <br />CC&R and Disclosure Requirements <br />14. The project developer shall record CC&R's at the time of recordation of the final <br />subdivision map, which shall create a Homeowners Association for the <br />development. The CC&R's shall be subject to the review and approval of the <br />City Attorney prior to recordation of the final map. <br />15. The CC&R's for the project shall prohibit the parking of boats, campers, and <br />trailers on Lots 1 through 51. <br />16. The recorded deed of sale for all lots covered by this PUD Development Plan <br />approval shall include the following: <br />a. The following disclosure in the CC&R's and in the notice to prospective lot <br />purchasers stating that the City of Pleasanton intends to develop and operate <br />a public trail staging area and a series of Class "A" Regional Trails and Class <br />"C" Local Trails for pedestrians/bicyclists/equestrians in the open space area <br />surrounding Lots 1 through 51 covered by this approval: <br />"You are hereby advised that this property is surrounded by open <br />space land zoned and/or used for the day-time activity relating to local <br />and regional public trails and park/trail staging areas.
