Butterfly survey and shall submit the survey to the USFWS to render a <br />decision regarding the presence/absence of Speyeria callippe callippe and, if <br />present, shall prepare a callippe Silverspot Butterfly Mitigation and Monitoring <br />Plan. (Mitigation Measure D-3 of the FEIR.) <br />d. To protect Alameda whipsnake populations from possible impacts during <br />construction through direct mortality, a silt-control fence plan shall be <br />prepared in consultation with the USFWS and, if required, shall be installed to <br />the satisfaction of he Planning Director and City Engineer 10 days before <br />grading begins and shall be maintained in place until grading is completed. <br />(Mitigation Measure D-6 of the FEIR.) <br />e. To mitigate the potential significant impact on United States wetlands and <br />waters from the proposed filling of 0.03 acres of Section 404 and isolated <br />wetlands and 145 linear feet - 0.003 acres - of United States waters in <br />drainages, the project developer shall mitigate the wetland impacts in the <br />form of creating on-site wetlands at a 2:1 ratio, and shall mitigate the stream <br />impacts by creating new drainages on-site at a 1:1 ratio, or preserve off-site <br />drainages at a 10:1 ratio. (Mitigation Measure D-8 of the FEIR.) <br />f. To mitigate the potential significant impact on California tiger salamander and <br />California red-legged frog movements to off-site breeding habitats from direct <br />mortality, the project developer shall implement the Hearst Drive wildlife <br />crossing features described in Mitigate Measures D-1 and D-2 of the FEIR. <br />At the discretion of the Planning Director, the above-described information may <br />be combined on a single drawing or combination of drawings or by other means, <br />provided that the information is clear, legible, and able to be used by the <br />reviewing authority in course of rendering its decision. <br />11. To meet the Mitigation Monitoring and Implementation Measures D-4 and D-5 of <br />the FEIR, the project developer shall perform the following: <br />• If grading is scheduled to begin during raptor breeding season as defined by <br />the California Department of Fish and Game, a qualified biologist shall <br />conduct apre-construction survey 30 days prior to the beginning of grading to <br />verify the presence/absence of active raptor nests. The project developer <br />shall implement the discussion points stated in the Oak Grove Draft <br />Environmental Impact Report. <br />• The project developer shall retain a qualified biologist to conduct apre- <br />construction survey 30 days prior to the beginning of site grading to verify the <br />presence or absence of burrowing owl nesting sites. The project developer <br />shall implement the discussion points stated in the Oak Grove Draft <br />Environmental Impact Report. <br />Construction shall not take place if it is determined by the biologists that such <br />construction would disturb an identified active raptor nest and/or burrowing owl <br />nest or burrow.
