1.3 Term of Maintenance Obligations. Except as <br />provided below, the Association's obligations under Section 1.2 <br />with respect to the area described in Section 1.1 shall commence <br />upon the later of (i) the date of this agreement, or (ii) the <br />date upon which the City Council of the City accepts ownership of <br />the street improvements and/or other public improvements under <br />construction in that area and shall continue throughout the term <br />of this agreement, unless terminated as provided in Section 5.3. <br />ARTICLE 2 <br />MAINTENANCE OF STREET LIGHTING <br />2.1 Areas for Street Lighting Maintenance. The <br />Association shall maintain all street lighting within Owens Drive <br />from the northern boundary of the crossing of Tassajara Creek <br />(including the culvert crossing of Tassajara Creek) to West Las <br />Positas Boulevard. <br />2.2 Maintenance Requirements. The Association shall <br />at its sole expense maintain all street lighting within the area <br />described in Section 2.1. Maintenance shall include the payment <br />of all charges for electrical usage, and the care of all street <br />lighting electroliers and bulbs, including repair and replacement <br />where necessary; provided that the Association's obligations <br />under this section with respect to the area described in Section <br />2.1 shall not include the replacement or repair of street <br />lighting electroliers unless ownership of said electroliers is <br />conveyed to the Association or the City. <br />2.3 Term of Maintenance Obligations. The <br />Association's obligations under Section 2.2. shall commence upon <br />the later of (i) the date of this agreement, or (ii) the date <br />upon which the City Council of the City accepts ownership of the <br />street improvements and other public improvements under <br />construction and shall continue throughout the term of this <br />agreement. <br />ARTICLE 3 <br />MAINTENANCE OF BUS SHELTERS AND STREET SIGNAGE <br />3.1 Bus Shelters. The Association shall at its sole <br />expense clean, maintain, repair, and replace, where necessary, <br />all bus shelters located in Public Service Easements along Owens <br />Drive from Tassajara Creek to West Las Positas Boulevard and <br />remove trash from trash receptacles at such bus shelters. <br />Cleaning and trash removal shall be done as frequently as <br />reasonably necessary to maintain the bus shelters in a sightly <br />condition, provided that trash removal shall be done at least <br />weekly. <br />~~ <br />
