3.2 Street Signage. The Association shall at is sole <br />expense maintain, repair, and replace, where necessary, all <br />street signs and traffic control signs located in the areas <br />described in Section 1.1 and in the Public Service Easements <br />along Owens Drive from Tassajara Creek to West Las Positas <br />Boulevard. <br />3.3 Term of Obligation. The Association's obligations <br />under Sections 3.1 and 3.2 shall commence upon the date of this <br />agreement. The Association's obligations shall terminate upon <br />the earlier of (a) expiration of the term of this agreement, or <br />(b) for any improvements described in Section 3.1 and 3.2 <br />located on any parcel shown on Parcel Map No. 4390, upon <br />commencement of construction of improvements for development of <br />all or any portion of the parcel in which such improvement is <br />located. <br />ARTICLE 4 <br />PERMISSION TO ENTER <br />The City hereby grants to the Association and its <br />agents, employees, and contractors permission to enter upon any <br />real property within the areas described in Sections l.l, 2.1, <br />3.1 and 3.2 owned by the City or for which the City has been <br />granted a public service easement or temporary landscape <br />easement, for the purposes of performing any maintenance required <br />under Sections 1.2, 2.2, and Article 3, provided that any and all <br />contractors employed by the Association to perform any <br />maintenance required under Sections 1.2, 2.2, and Article 3 must <br />obtain an encroachment permit from the City, which the City shall <br />issue without charge to such contractor or to the Association. <br />ARTICLE 5 <br />ASSESSMENT DISTRICT <br />5.1 Maintenance District Contemplated. The City, <br />Prudential, CPPP and the Association contemplate the possible <br />establishment of a landscaping and street lighting maintenance <br />district (the "District") pursuant to California law for the <br />purposes of maintaining the landscaping, street lighting, and <br />other public improvements covered by this agreement. <br />5.2 Cooperation. The City agrees that, upon receipt <br />of an appropriate petition, it shall cooperate with Prudential, <br />CPPP, the Association, and other land owners within Hacienda <br />Business Park or within property included in Parcel Map No. 4390 <br />to undertake and complete any proceedings required under <br />California law for the establishment of the District. <br />6 <br />
