WHEREAS, City policy requires that its actions be consistent with providing and <br />protecting trail access within the Pleasanton Ridgelands. <br />NOW, THEREFORE, City and Owner hereby agree as follows: <br />1. Provision of Water Service. Owner may connect to City's water system upon <br />execution of this Agreement prior to annexation of Owner's land. The connection shall be in <br />accordance with the following: <br />(a) Owner shall design a private water connection to the City's existing water <br />system to the satisfaction of the City Engineer. Said private water system <br />may serve additional parcels as approved by the City. All costs associated <br />with construction of the private water system shall be borne by Owner and <br />other private parties who may also be served by it. Should the private <br />system serve more than Owner, Owner shall demonstrate to the City's <br />satisfaction that all necessary easements, maintenance agreements, and <br />other legal documents as may be necessary aze in place to allow the <br />private system to operate satisfactorily on a long-term basis. <br />(b) For any new connection, other than the existing water connection, Owner <br />shall pay the water connection fees in effect at the time of the new <br />connection. <br />(c) Owner shall pay a monthly water service chazge as is now or may in the <br />future be provided by ordinance. <br />2. Provision of Sewer Service. Owner may connect to City's sewer system upon <br />execution of this Agreement and approval by LAFCo prior to annexation of Owner's land. The <br />connection shall be in accordance with the following: <br />(a) Owner shall design a private sewer connection to the City's existing sewer <br />system to the satisfaction of the City Engineer. Said private sewer system <br />may serve additional pazcels as approved by the City. All costs associated <br />with construction of the private sewer system shall be borne by Owner and <br />other private parties who may also be served by it. Should the private <br />system serve more than Owner, Owner shall demonstrate to the City's <br />satisfaction that all necessary easements, maintenance agreements, and <br />other legal documents as may be necessary aze in place to allow the <br />private system to operate satisfactory on a long-term basis. <br />(b) Owner shall pay the sewer connection fee in effect at the time of <br />connection to the sewer system as provided in the applicable City <br />ordinances. <br />Page 2 <br />
