WHEN RECORDED, RETURN TO: <br />RECORDED BY: <br />PRE-ANNEXATION AND UTILITY SERVICE AGREEMENT <br />,~/ <br />THIS AGREEMENT is made and entered into this~day of 199~~ <br />by and between the City of Pleasanton, a municipal corporation (hereinafter referred to as "City") <br />and Shazon and Mike Fuller (hereinafter referred to as "Owner"), based on the following <br />understandings: <br />WITNESSETH: <br />WHEREAS, Owner wishes to connect their residence located at 4120 Foothill Road <br />(APN#941-2100-001-04) to the City sewer system and modify its connection to the City water <br />system; and <br />WHEREAS, generally, City policy requires annexation prior to extension of such City <br />services as sewer facilities; and <br />WHEREAS, Owner has asked to annex its property to the City, but Owner wishes to <br />connect to the sewer facilities and upgrade its water facilities prior to the annexation becoming <br />effective; and <br />WHEREAS, upgrading the water system will improve fire protection and connecting to <br />the sewer system will eliminate an existing septic tank/leachfield system on hillside land better <br />dewatered for landslide safety; and <br />WHEREAS, City policy is adequately preserved through the provisions of an agreement <br />wherein Owner consents to annexation to City at such time as City may require; and <br />WHEREAS, City is willing to allow connection to its facilities only if there aze <br />assurances that the property won't be further subdivided or developed in the County prior to <br />annexation without approval of the City; and <br />WHEREAS, Owner's property is traversed along its westerly edge by the access road to <br />the Berz property ("Bert roadway"); and <br />WHEREAS, the general alignment of the Berz roadway is a potential trail within the <br />master plan for East Bay Regional Pazk District's Pleasanton Ridgelands Park; and <br />Page 1 <br />
