(c) Owner shall pay a monthly sewer service charge as is now or may in the <br />future be provided by ordinance. <br />(d) Owner shall pay the processing fees to LAFCo required for its approval of <br />extension of City services beyond its City limits. <br />3. Agreement to Annex. Owner consents to annex to the City of Pleasanton all those <br />lands described herein at such time as City may require. This Agreement, State and County <br />laws, and City ordinances and resolutions shall control the responsibilities of both parties at the <br />time of annexation. Owner shall cooperate with City in the annexation of the lands described <br />herein, whether alone or as part of a lazger azea; expressly waives the right to protest said <br />annexation; and shall agree to do no act calculated or tending to prevent, impede, or defeat the <br />successful annexation of said property. <br />4. No Further Subdivision. Owner shall not subdivide nor develop the property <br />while it is within the jurisdiction of Alameda County without the written approval of the City. <br />5. Dedication of Trail Easements. Prior to annexation, Owner shall prepare legal <br />descriptions and easements, satisfactory to the City, which shall accomplish the following: <br />(a) Dedicate to East Bay Regional Pazk District the right to use that portion of <br />the Berz roadway which lies within the Owner's property for park and trail <br />maintenance and emergency use. <br />(b) Dedicate to East Bay Regional Park District a trail easement of sufficient <br />width to allow a future trail to be constructed along and/or over the Berz <br />roadway as it traverses the westerly edge of the Owner's property; use of <br />this easement by the public shall be contingent upon East Bay Regional <br />Park District's establishment of a trail connecting Santos Ranch Road to <br />the south of the Owner's parcel to the Garms Ranch trail to the north of the <br />Owner's parcel, generally along the alignment of the Berz roadway, as part <br />of the regional trail system of Pleasanton Ridgelands Pazk. <br />(c) The terms of these easements shall address such issues as use, <br />indemnification, fencing, and such other issues as City and Owner shall <br />determine necessary to protect the interests of all parties. East Bay <br />Regional Pazk District shall be a party to the final terms of the easements. <br />Any dispute over the terms shall be resolved by the City Council <br />following a hearing on these matters. <br />6. Street Address. Owner agrees that upon annexation it shall modify its address to <br />use a street name consistent with the approved street layout which will provide the Owner's <br />access on a new street which will intersect Equus Court. <br />Page 3 <br />
