the Director of Engineering of the City of all such estimated costs. 4. Conditions to Delivery of Grant Deed. 4.1 Stoneson Certificate. City shall deliver to Foothill a letter or other written statement, in form and content reasonably satisfactory to Foothill, from The Stoneson Development Corporation, a California corporation, (hereinafter referred to as "Stoneson"), grantor under that certain Grant Deed (the "Grant Deed") from Stoneson to Lee Sammis Company, a California corporation, dated January 7, 1981, and recorded January 9, 1981, as Instrument No. 81-4519 in the Official Records of Alameda County, California, and declarant under that certain Agreement of Covenants, Conditions and Restrictions dated November 5, 1980, (hereinafter referred to as the "CC&R's"), between Stoneson and Wells Fargo Bank, National Association, as Trustee under a Trust Agreement dated April 21, 1978 whereunder Trust No. 5-102510 was created for the benefit of Stoneridge Properties, a California limited partnership, recorded January 9, 1981, as Instrument No. 81-4518, in the Official Records of Alameda County, California, which certifies as follows: (a) that the site plan attached hereto as Exhibit "B" has been approved by Stoneson as declarant as required under Section 3. (A) of the CC&R's; and (b) that the site plan attached hereto as Exhibit "B" provides for sufficient parking to satisfy the requirements of Section 4 of that certain Agreement Re Restrictions on -5-
