the Director of Engineering of the City of all such estimated <br />costs. <br />4. Conditions to Delivery of Grant Deed. <br />4.1 Stoneson Certificate. City shall deliver to <br />Foothill a letter or other written statement, in form and <br />content reasonably satisfactory to Foothill, from The Stoneson <br />Development Corporation, a California corporation, (hereinafter <br />referred to as "Stoneson"), grantor under that certain Grant <br />Deed (the "Grant Deed") from Stoneson to Lee Sammis Company, <br />a California corporation, dated January 7, 1981, and recorded <br />January 9, 1981, as Instrument No. 81-4519 in the Official <br />Records of Alameda County, California, and declarant under <br />that certain Agreement of Covenants, Conditions and Restrictions <br />dated November 5, 1980, (hereinafter referred to as the "CC&R's"), <br />between Stoneson and Wells Fargo Bank, National Association, <br />as Trustee under a Trust Agreement dated April 21, 1978 <br />whereunder Trust No. 5-102510 was created for the benefit of <br />Stoneridge Properties, a California limited partnership, <br />recorded January 9, 1981, as Instrument No. 81-4518, in the <br />Official Records of Alameda County, California, which certifies <br />as follows: <br />(a) that the site plan attached hereto as Exhibit <br />"B" has been approved by Stoneson as declarant as required <br />under Section 3. (A) of the CC&R's; and <br />(b) that the site plan attached hereto as Exhibit <br />"B" provides for sufficient parking to satisfy the requirements <br />of Section 4 of that certain Agreement Re Restrictions on <br />-5- <br />
