Use of Land dated May 25, 1978, (hereinafter referred to as <br />the "Agreement Re Restrictions"), and recorded May 25, 1978, <br />in Book 5410, Page 39, as Instrument rto. 78-098529 of the <br />Official Records of Alameda County, California. <br />4.2 Stoneridge Certificate. City shall deliver <br />to Foothill a letter or other written statement from Stoneridge <br />Properties, a California limited partnership, (hereinafter <br />referred to as "Stoneridge"), the "owner of the benefited <br />parcel" under the CC&R's, in form and content satisfactory <br />to Foothill, which certifies as follows: <br />(a) that the site plan attached hereto as Exhibit <br />"B" has been approved by Stoneridge as required under <br />Sections 3. (A) and 3. (C) of the CC&R's; and <br />(b) that the site plan attached hereto as Exhibit <br />"B" provides for sufficient parking to satisfy the requirements <br />of Section 4 of the Agreement Re Restrictions. <br />4.3 Letter(s) from City. City shall deliver to <br />Foothill one or more letter(s) stating (1) that the site <br />plan attached hereto as Exhibit "B" has been approved by the <br />City's Planning Department, (2) that the period of time for <br />appeal to City Council of such Planning Department approval <br />has run, (3) that the Engineering Department has approved <br />the modified improvement plan, and (4) that no further City <br />review or approval shall be required prior to commencement <br />of reconstruction of the Centerpointe parking lot, landscaping <br />plan, irrigation system and pedestrian/bikepath along the <br />realigned Canyon Way as shown on Exhibit "B". <br />-6- <br />
