1 above and the reconstruction of the revised pa~~king area <br />described in Sectio:~ 2, City, shall pay Foothill the sum of <br />Twelve Thousand Fifty, and No/100ths Dollars ($12,050.00) <br />concurrently with Foothill's delivery of the grant deed for <br />the Right-of-Way. <br />3.2 Payment of Additional Costs. As partial <br />consideration for the grant of the Right-of-Way described in <br />Section 1 above and the reconstruction of the revised parking <br />area described in Section. 2, City shall reimburse Foothill <br />for all net additional costs incurred by Foothill in <br />constructing the revised parking area, including but not <br />limited to any necessary design and engineering costs, <br />demolition, new curbs, and additional paving. City also <br />shall reimburse Foothill for any extra cost incurred or to <br />be incurred for landscaping, irrigation systems, or other <br />costs, including but not limited to design and engineering <br />costs necessitated by the revision and reconstruction of the <br />Centerpointe project to develop it as shown on Exhibit "B" <br />hereto. Calculation of the required reimbursement for net <br />additional costs incurred shall be made on a per unit cost <br />basis when possible. Estimates of the net reimbursable <br />additional costs shall be sufficient basis for determining <br />the final payment, provided such estimates are approved by <br />the Director of Engineering of the City, which approval <br />shall not be unreasonably withheld. Payment of the net <br />additional costs shall be made by the City concurrently with <br />the payment provided in Section 3.1, subject to approval by <br />-4- <br />
