NOW, THEREFORE, the parties hereto agree as follows: <br />1. Grant of Right-of-Way. Upon satisfaction of the <br />conditions set forth in Section 4, Foothill shall grant and <br />convey to City that certain real property (hereinafter <br />referred to as the "Right-of-Way") containing approximately <br />1,057 square feet shown on Exhibit "A" and described in <br />Exhibit "A-1", both of which are attached hereto and incorporated <br />herein by this reference. <br />2. Reconstruction of Revised Parking Area. Upon <br />satisfaction of the conditions set forth in Section 4, Foothill <br />shall design, revise and reconstruct the Centerpointe parking <br />lot, landscaping plan, irrigation system, and pedestrian/bikepath <br />along the realigned Canyon Way substantially as shown on the <br />dimensional site plan designated "revised 1/12/83" attached <br />hereto as Exhibit "B" and by this reference incorporated herein. <br />Said plan includes the addition of new spaces to be located in <br />planned landscaped areas and modification of certain parking <br />spaces to have eight foot eight inch (8'8") width dimensions <br />rather than the nine foot (9') width dimensions previously <br />approved in Case Z-81-117 and Case Z-82-160. The total number <br />of parking stalls in the revised parking lot shall number <br />642. The revised pedestrian/bikepath located easterly of <br />Centerpointe, shall be eight feet (8') wide and shall be <br />located five feet (5') off of the future face of the curb. <br />3.
