C. The widening of Canyon Way contemplated by City <br />will affect the development of Centerpointe as approved and <br />will necessitate modification of some of the improvements <br />already constructed on the Centerpointe site. In particular, <br />the widening of Canyon Way will reduce the number of on-site <br />parking spaces in Centerpointe and necessitate redesign of <br />the on-site parking area. <br />D. Foothill wishes to revise the on-site parking plan <br />to replace the on-site parking spaces lost due to the widening <br />of Canyon Way. Foothill further wishes assurance that <br />future development of Pad A may proceed in accordance <br />with the prior approval despite the loss of some site area <br />due to the widening of Canyon Way. <br />E. Foothill further seeks assurance that the revisions <br />to the site plan contemplated by Foothill and the City herein <br />meet the requirements of the CC&R's governing their development <br />of the Centerpointe site in order to ensure that future <br />contemplated development and use of the site is consistent <br />with those CC&R's and the approval of the former development <br />plan. <br />F. City and Foothill have reached mutual understanding <br />with respect to the resolution of City's acquisition of <br />the necessary right-of-way for the widening of Canyon Way, <br />for the replacement of lost parking spaces, and for revision <br />of the parking area to enable Foothill to develop Centerpointe <br />substantially as approved by the City in Case Z-81-117 and <br />Case Z-82-160, and the parties wish to set forth their mutual <br />understandings in this Agreement. <br />-2- <br />
