a) annexation of areas designated for open spaces on Lot 2 and Lot 3 of this <br />development to the Urban Wildland Interface district of Tract 6400 (the <br />Preserves). The annexation document shall be approved by the City Attorney <br />prior to recording. <br />b) a wildland fire protection plan for the areas designated for open spaces on Lot 2 <br />and Lot 3 of this development. This document shall be reviewed and approved by <br />the Fire Marshal and the Planning Director prior to recording. <br />c) designation of the area identified as Parcel A of Lot 3 for open space. The specific <br />language of open space designation shall be review and approved by the City <br />Attorney prior to recording. <br />24. All retaining walls visible from Dublin Canyon Road shall be finished with natural <br />materials. <br />25. The applicant shall disclose to the future owner of Lot 3 that prior to the issuance of a <br />building permit, the property owner shall submit the following: <br />a) a conformation letter from Nicholas Engineering, Inc. stating that the <br />recommendations included in the original geotechnical report prepared in 1999 <br />are applicable for the proposed development; and, <br />b) a grading and drainage plan that thoroughly evaluates the high water content on <br />the subject site. <br />26. The fina] grading plan for Lot 3 shall include a retaining wall between Lot 2 and Lot 3. <br />The detail of the retaining wall is subject to the approval by the Planning Director prior to <br />the issuance of a building permit. Additionally, the final grading shall reflect the <br />recommendations stated in geotechnical peer review report by Alan Kropp & Associates <br />included in the Exhibit A. <br />27. Final inspection by the Planning Department is required prior to occupancy of the <br />dwellings. <br />Minor Subdivision/Pareel Map: <br />28. Prior to issuance of a building permit for the project, a minor subdivision (parcel map) <br />shall be approved by the City and recorded. <br />Existing Trees: <br />29. The applicant shall post cash, letter of credit, or other security satisfactory to the Planning <br />Director in the amount of $12,200 for the Valley oak tree that is required to be preserved. <br />This cash bond or security shall be retained for one year following completion of <br />construction and shall be forfeited if the tree is removed, destroyed, or disfigured. <br />
