30. Prior to issuance of a grading or building permit, a temporary six-foot tall chain link <br />fence shall be installed around the Valley oak as a protection measure. Fencing shall <br />remain in place until final occupancy is granted for the dwellings; removal of such <br />fencing prior to that time may result in a "stop work" order. <br />31. The applicant shall strictly follow the recommendation stated in the report, prepared by <br />HortScience, included in Exhibit A, on file in the Planning Department, subject to review <br />by the Planning Director. <br />Landscaping and Irrigation System Design and Operation: <br />32. A final landscape plan and irrigation plan shall be submitted to and approved by the <br />Planning Director as part of the building permit plan set prior to issuance of an on-site <br />permit. Said landscape plan shall be consistent with the approved landscape plan, <br />including planting along the rear property line on both lots, plus any conditions of <br />approval, and shall be detailed in terms of species, location, size, quantities, and spacing. <br />33. The landscaping material use in Parcel A of Lot 3 shall be native species. <br />34. Trees used in landscaping shall be a minimum 24-inch box size. The applicant shall pay <br />a fee in the amount of the appraised value less the value of the 24-inch box or replant at a <br />ratio to exhaust the appraised value. All shrubs a minimum of five (5) gallons, unless <br />otherwise conditioned or shown on the approved landscape plan. <br />35. The project developer shall provide root control barriers and four inch (4") perforated <br />pipes for the street trees. <br />Biological Assessment: <br />36. The applicant shall strictly following the recommendations stated in the Biological <br />Assessment report prepared by W12A, included in Exhibit A, on file with the Planning <br />Department. <br />37. All construction shall be scheduled outside the bird-breeding season (February through <br />August). In an event that the construction cannot be scheduled outside the bird-breeding <br />season, a wildlife biologist shall be contracted at the owner's expense to conduct a <br />breeding bird survey within thirty (30) days of the scheduled construction to determine if <br />nesting birds aze present. The wildlife biologist shall provide a letter stating that no <br />nesting birds are present prior to commencement of construction. <br />If nesting birds are observed, the wildlife biologist shall recommend mitigation measures <br />to minimize the construction disturbance to the nest birds. Mitigations may include but <br />are not limited to establishing buffers no less than fifty (50) feet from active nests until <br />young birds have fledged the nest. The written mitigations shall be submitted to the <br />Planning Director for review and approval prior to commencement of construction. <br />
