EXHIBIT B <br />CONDITIONS OF APPROVAL <br />PCUP-163, Gayle Thomas <br />Tommy T's Comedy Club and Restaurant <br />5104 Hopyard Road <br />June 14, 2006 <br />The operation of the proposed use shall conform substantially to Exhibit A (dated <br />"Received" Mazch 17, April 14, and Apri125, 2006), on file with the Planning <br />Department, except as modified by these conditions. Minor modifications to the <br />operation of the use and conditions of approval maybe approved by the Planning <br />Director if determined to be in substantial conformance with the approved use permit. <br />The operation of the business shall be limited to the following hours: 11:00 a.m. to <br />12:00 midnight, Sunday through Thursdays; and 11:00 a.m. to 1:30 a.m., Fridays and <br />Saturdays. Alcohol service on Fridays and Saturdays shall cease at 1:00 a.m. Comedy <br />shows shall be limited to the following number of shows, days, and times: one show <br />starting at 8:00 p.m. on Tuesdays, Wednesdays, Thursdays, and Sundays; and two shows <br />starting at 8:00 p.m. and 10:30 p.m. on Fridays and Saturdays. "Happy hour" shall be <br />limited to 4:00 p.m. to 6:00 p.m., Monday through Friday. This use permit has been <br />approved to discount alcoholic beverages during "happy hour" by $1.00 off of the <br />regular, non-happy hour pricing of $4.50 to $7.00. Should the applicant wish to increase <br />the happy hour discount or create other reduced-price alcohol promotions, the <br />modification shall be subject to the review and approval of the Planning Director. <br />In the event that the applicant proposes to modify the hours or other aspects of the <br />business operation, the modification shall be subject to the review of the Planning <br />Director. The Planning Director may approve the modification or refer the matter to the <br />Planning Commission if judged to be substantial. <br />4. The applicant (or designated representative of the business) shall maintain the area <br />surrounding the building and its parking lot in a clean and orderly manner at all times. <br />The applicant shall regularly monitor the area outside of the building to ensure peace and <br />quiet. <br />If, at any time in the future, the activities of the operation deviate from those described in <br />Exhibit A, or in the event that operation of this use results in conflicts pertaining to <br />parking, interior or exterior noise, vibrations, traffic/circulation, litter, odors, loitering, <br />fighting, or other factors, at the discretion on the Planning Director, this conditional use <br />permit maybe submitted to the Planning Commission for their subsequent review at a <br />public hearing. If necessary, the Commission may modify or add conditions of approval <br />to mitigate such impacts, or may revoke said conditional use permit. Possible mitigation <br />measures can include, but are not limited to: reducing the number of seats and/or tables, <br />restricting the hours of operation, hiring additional security personnel, restricting alcohol <br />service, and/or installing noise mitigating measures/devices. <br />
