City Attorney Michael Roush addressed the Commission. He suggested that the City <br />could specifically state that the five year time period (or other period as deemed <br />appropriate) could be made to start at the final map or some other specific date so that the <br />developer's concerns could be accommodated while still preserving the spirit of the IZO. <br />Marty Inderbitzen stated that Mr. Roush's suggestion is workable. Alternatively, the City <br />could require that they report back in five years if they need to request more time. His <br />main concern is that the IZO states that the units must be produced in five years, and they <br />do not feel that they can meet that deadline if it is tied to approval of the Affordable <br />Housing Agreement which is early in the entitlement process. <br />The Commission discussed the earlier motion. Commissioner Jones agreed to <br />modify his motion to require that the units be produced within five years starting <br />from approval of the final map and that the developer provide the City with an <br />annual progress report. Vice Chairperson Stark seconded the motion. Motion <br />approved unanimously. <br />The Commission thanked Mr. Inderbitzen and Mr. Roush for attending the meeting. <br />Page-3- <br />
