Mr. Bocian stated that the City's Inclusionary Zoning Ordinance allows the use of <br />various alternatives to meet the City's inclusionary requirement subject to review and <br />approval by the City Council. However, the provisions in the IZO accommodate the <br />developer's proposal with exception of the requirement that units be produced within five <br />years. Mr. Bocian noted that as an alternative to the above proposal, the developer can <br />meet its IZO requirements by paying the City's in-lieu fee estimated at $479, 043. <br />Due to the unique features of the Oak Grove project, staff is recommending that the <br />Commission recommend approval of the developer's proposal to satisfy the City's <br />inclusionary requirement by the use of off-site units as outlined above. If the <br />Commission approves the developer's proposal staff will incorporate the concept into the <br />development agreement and into the affordable housing agreement that will be forwarded <br />to the City Council as part of the project approval documents. <br />The Commission invited comments from members of the public. <br />Marry Inderbitzen, 4218 Casterson Court, Pleasanton, addressed the Commission as the <br />applicant's representative. He addressed staff's comment regarding the proposed ten- <br />year compliance period, stating that realistically it will be approximately three years <br />before construction on the project can actually begin construction. In addition, the <br />project consists of custom home lots so absorption is a factor that will affect the progress <br />and timing of the project. Therefore, ten years was felt to be a more practical time period <br />for fulfilling the alternative of building affordable units off site. <br />The Commission asked staff is there are any parcels of land available today in the city <br />where affordable housing could be built. Mr. Bocian replied that there are sites and that <br />the City Council's preferred land use plan identifies potential locations. <br />Vice Chairperson Stark asked whether it would be appropriate to require a cash <br />performance bond to ensure compliance with the terms of the Affordable Housing Plan. <br />Mr. Bocian stated that there is a provision in the IZO, but staff does not believe that it <br />would be necessary in this case. <br />Commissioner Jones commended Mr. Inderbitzen for putting together a project <br />that addresses the City's inclusionary requirement in a creative way. He put a <br />motion on the floor to approve the project per staff s recommendation. <br />The Commission discussed the motion. Chairperson Hodgett stated that she is somewhat <br />uncomfortable with the proposed ten-year time frame. She proposed that the agreement <br />state afive-year period consistent with the language in the IZO but with the provision for <br />another five-year extension if there are factors that warrant additional time. <br />Page-2- <br />
