However, the agreement could expire and <br />the ordinance would then become effective and apply. <br />Councilmember Thorne said he visited the park prior to last April, said there were glaring safety <br />hazards, acknowledged the sidewalks were now getting fixed, and he wanted to see something <br />return to the Council that would work and would be enforceable. He also indicated to Mr. Hoon <br />that he felt the repairs made to the sidewalk were a joke and not truly repaired. <br />Mayor Hosterman confirmed that the enforcement mechanism in an ordinance included the <br />issuance of citations, fines, the filing of a civil action for abatement of a violation, and similarly, a <br />lawsuit could be filed for breach of the agreement. If the Council included an administrative <br />remedy section in the new agreement, disputes might be heard more quickly than are done <br />now. <br />Councilmember McGovern confirmed that a list of agreed-upon capital improvements for <br />Vineyard Villas would be done if a proposed rent increase occurred in the amount of $28-$34, <br />which was an increase of approximately 4%. She requested staff prepare a pro's and con's of <br />the ordinance in place and the pro's and con's of a rental stabilization agreement for this and <br />any other mobile home properties in town. She referred to Exhibit 2; the Hacienda Mobile Home <br />Park maintenance standards done on a monthly basis, she confirmed with Mr. Hoon this has <br />been in place over the last 1-2 years which was prepared together with the City Attorney and <br />himself, agreed that most items except for tree trimming, were done regularly and that the <br />Board's maintenance community had a copy of it but it was not posted currently in the Park. Mr. <br />Hoon agreed to distribute it to each resident and also post it for the residents to ensure items <br />were regularly being addressed. She said safety issues were not included on the maintenance <br />list, such as replacing the water heater in the laundry room, replacing inoperable washers and <br />dryers, installing hand rails at the exit from the clubhouse to the pool deck and landscaping and <br />irrigation items, and she confirmed some of the items were in progress. Mr. Hoon felt some of <br />the machines were not used much by residents and said they were taking steps to installing <br />hand railing in two different locations. Councilmember McGovern felt washers and dryers might <br />be used more if they were repaired. She felt new energy bulbs were not being installed and <br />solar was being considered, and she felt a survey was needed by Mr. Hoon; that he place every <br />item to be done on a list by its prioritization and estimated cost of the capital improvement in <br />order to build the trust again of residents. <br />Councilmember Sullivan agreed with having an ordinance in place versus an agreement, <br />questioned what enforcement options were included in the existing agreement and whether or <br />not they have been utilized, and felt part of the decision should include an agreement with some <br />enforcement structure. <br />Mayor Hosterman felt there was a profound difference in perception of what was going on, <br />appreciated residents being civil, felt trust needed to be built with Mr. Hoon, requested having <br />items be put in writing as well as having a schedule and prioritizing items. <br />Mr. Hoon said prior to the meeting the Council asked residents not to be negative toward him <br />because of the emotional issues. He said he has 120 other households who were supportive, <br />felt it was important to build the trust of all residents as well as the Council and was agreeable to <br />meeting with Councilmembers on-site. <br />City Council Minutes 7 August 21, 2007 <br />
