Councilmember Cook-Kallio voiced concern over maintenance issues that had not been taken <br />care of from five months ago, recognized Mr. Hoon's attempts in procuring contractors and bids, <br />asked Mr. Hoon to be inspired by the safety of residents in the mobile home park and not <br />Vineyard Vista and believed that pass-through's were burdensome to people on fixed incomes. <br />She asked for a definition of the difference between what maintenance was and what was <br />considered capital improvement and what happens when the refusal to maintain something <br />results in a capital improvement and felt there was a lack of maintenance over time. <br />City Attorney Roush said there is a list of capital improvements identified for each of the parks, <br />they look at what the useful life of a particular capital improvement is and if that has been in <br />existence for more than its useful life, the owner is allowed to replace that capital improvement <br />and recover the cost from the owner. <br />Councilmember Cook-Kallio referred to trees lifting up sidewalks and the City's work to grind <br />down the sidewalk until the capital improvement can be done. She felt it was unfair to pass the <br />majority of the funds through to the residents if the maintenance had not been done. City <br />Attorney Roush felt that was accurate but did not believe the cost to make the sidewalk repairs <br />were considered capital improvements. <br />Mr. Hoon said he renovated the pool room at his own expense, said the sidewalks have been <br />ground down, they had patches put on them in order to make them safe, he walked the park <br />and covered every sidewalk identifying 7 spots where they wanted to add additional concrete <br />and more leveling. However, he said contractors walked the park and he felt grinding down and <br />patching it would not last long. He said Vineyard improvements took 10 years and he wanted to <br />put those same improvements in Hacienda, as well. <br />Councilmember Cook-Kallio said she was concerned about why this work happened the two <br />weeks prior to the Council meeting and did not begin prior to the April meeting. She said many <br />residents were very frustrated and her comments deal more with the slowness of the response <br />and not whether sidewalks are ground down and patched, as they were simply examples. <br />Councilmember Sullivan said Mr. Hoon indicated he was meeting with the park next door <br />regarding their agreement and asked for a comparison of the two mobile home parks and the <br />agreements. City Attorney Roush said the parks were similar in size, both have clubhouses and <br />pools, both are senior parks, both developed in the 1970's, both have seen transition in turn- <br />over of new homes since 2000 or so and both are very nice parks. He said the Vineyard Villas <br />agreement differs from the current agreement with respect to the fact that there are items such <br />as replacement of streets, sewer lines, storm drains, all of which would fall under capital <br />improvement items. Many residents are concerned this will get passed onto them. A proposal <br />has been made by the owner that, in exchange for an immediate rent increase beginning in <br />2008, the owner would take on all improvements without passing them onto the residents in <br />perpetuity. He said the committee he has been meeting with felt it was a reasonable insurance <br />policy for residents to consider, they can make their own decision, and depending upon where it <br />goes, it will return to Council. He questioned if on-going maintenance issues were included in <br />the agreement and asked what could be done to have problems immediately addressed. Mr. <br />Roush said maintenance standards set forth in the staff report exhibit are applicable to both <br />parks. He said the issues do not seem to be as dramatic to residents at Vineyard Villas and <br />capital improvements exist in both parks. Regarding maintenance items getting the attention <br />they need, Vineyard residents would agree they must push management to get things done. He <br />felt similar regulatory and enforcement processes would apply, but neither managers were <br />overly pro-active in addressing concerns. He felt the focus regarding repairs would occur during <br />City Council Minutes 6 August 21, 2007 <br />
