Ms. Decker <br />noted that Exhibit A, the narrative and the description of business operations, plans, and layouts <br />were enforceable, as was Exhibit B, being the conditions of approval. <br />Commissioner Blank inquired about the use of the word "substantially," with respect to the <br />children's ages, such as athree-year-old or a 13-year-old. <br />Ms. Harryman noted that it would be easier for the City to enforce items within the conditions of <br />approval as opposed to the staff report. She noted that the staff report was particularly useful <br />when interpreting the intent of items in the conditions of approval that were more implied than <br />explicit. She noted that the word "substantially" was commonly used by lawyers that was not <br />sharply defined and was subject to interpretation. <br />Commissioner O'Connor suggested that the condition state that all children be escorted. <br />With respect to the reference to the operating schedule, Commissioner Blank inquired about the <br />use of the word "generally." Ms. Decker interpreted that to mean that there would be some <br />flexibility in terms of five minutes either way; on the other hand, if the school were to adhere to a <br />specific schedule, that would be stated. Commissioner Blank noted that an article in the <br />newspaper (distributed to the Commission) stated, "Eazly morning and afternoon classes will be <br />reserved for students as young as 4, while later evening classes will be reserved for older <br />children and adults." He did not know whether that implied that there would be eazly morning <br />classes on weekdays or late evening classes on the weekends. He inquired whether there would <br />be afternoon classes during the week or evening classes on Saturday and Sunday and requested <br />clarification. Ms. Decker noted that the applicant noted the operating hours would be Monday <br />through Friday from 3:00 p.m. unti19:00 p.m. and Saturday and Sunday from 8:30 a.m. to <br />5:00 p.m. She believed the article discussed the Fremont site. Commissioner Blank requested <br />that the language regarding the schedule include "plus or minus one hour." <br />Chairperson Fox wanted to ensure the school closed by 9:00 p.m. so the neighborhood across the <br />street would not be disturbed. Commissioner Blank suggested that the language regarding the <br />schedule read "plus or minus 30 minutes." That suggestion was generally acceptable to the <br />Commission. <br />Commissioner Blank inquired whether Chairperson Fox intended for the parent of a 12-year-old <br />to wait on-site during the class. Chairperson Fox noted that she would like the pazenUguazdian <br />of afour-year-old to remain on-site but that she would be more flexible fora 12-year-old. <br />Commissioner Blank did not want the language to be unduly restrictive for the parents. <br />Chairperson Fox suggested that children ten years or younger be supervised on-site by a pazent <br />or guardian. <br />Commissioner Blank suggested that staff work with the applicant to come up with a suitable <br />condition that would accomplish the Planning Commission's concerns. <br />PLANNING COMMISSION MINUTES February 14, 2007 Page 3 of 14 <br />
