PCUP-188 Tao He/USA Wu Chi Kuue Fu Academy <br />Application for a conditional use permit to operate a martial arts center for children and <br />adults on Monday through Friday from 3:00 p.m. to 9:00 p.m. and on Saturday and <br />Sunday from 8:30 a.m. to 9:00 p.m. in an existing building located at 5682 Stoneridge <br />Drive, Suite B. Zoning for the property is PUD-UC-O (Planned Unit Development - <br />IndustriaUCommercial-Office) District. <br />Chairperson Fox stated that she would like to add three conditions of approval. The first <br />addition regarded pick-up of children, with the suggested language reading: "The applicant shall <br />ensure that children remain inside until picked up and that they are supervised on-site by a <br />pazenUguazdian." She noted that the language could reflect past determinations by the Planning <br />Commission on similar projects. The second condition would require temporary signage to be <br />approved by the Planning Department. The third condition would ensure that in addition to <br />Condition No. 9, "At no time shall balloons, banners, pennants, window signs, including <br />paintings, painted words and such, or other attention-getting devices be utilized." She noted that <br />there had been a previous problem in that shopping center with Bay Books. <br />Ms. Decker wished to clarify that the City typically required that no more than 25 percent of the <br />window area maybe covered by signage. Staff anticipated the same standard to be held in this <br />project. Chairperson Fox believed that the Municipal Code requirement only applied to the <br />Downtown and requested that it be specifically included in this condition. She also requested <br />that no spray-painted signage be placed on the windows. <br />Ms. Decker noted that there had been an error with respect to the CEQA exemptions. She noted <br />that the project was categorically exempt, and the section cited, 15303, should be 15301 Class I <br />(Existing Facilities). <br />Chairperson Fox wanted to ensure that the children would not exit the building following a class. <br />Ms. Decker noted that a previous similaz project had a similaz request that the pazents escort the <br />children in and out of the building. That condition could serve this project as well. <br />Commissioner Blank noted that he did not have an issue with that condition and inquired to what <br />ages of the children this would apply. Ms. Decker noted that it could conceivably be between <br />ages four and 12; children over 12 would not be subject to the same requirements. <br />Commissioner Blank believed that there were mixed messages between the binding nature of the <br />staff report and the conditions of approval. Ms. Decker noted that the conditions of approval in <br />the staff report were the binding conditions. Commissioner Blank noted that contradicted a <br />statement made by the Planning Director; Ms. Decker noted that she would discuss this with the <br />Director and report back to the Commission. <br />Commissioner Pearce noted that the distinction might be that Condition No. 1 of Exhibit B <br />° stated, "The use shall conform substantially to Exhibit A, which includes site plan, floor plan and <br />PLANNING COMMISSION MINUTES February 14, 2007 Page 2 of 14 <br />
