to affect an exchange pursuant to Internal Revenue Code <br />Section 1033 or 1031. <br /> <br /> 2.2 Lin agrees to apply all funds received in <br /> <br />connection with the aformentioned purchase to the <br />acquisition of right-of-way and construction of the <br />Bernal/Bonde extension. <br /> 2.3 To the extent said funds, when taken in <br /> <br />addition to the $596,000 committed to the Bernal/Bonde <br />extension by way of long term agreements, exceed the <br />necessary funding including reasonable contingencies to <br />complete the Bernal/Bonde extension they shall be paid to <br />Lin forthwith. <br /> <br /> 2.4 City agrees that it ~ill use its "best <br />effort" to establish a benefit distri~L or a reimbursement <br />agreement pursuant to California Government Code Sections <br />66484, and following, or Sections 66485, and following, or <br />any other applicable provisions of law for all lands within <br />the a~ea of the Vineyard Avenue Moratorium established by <br />City Council Resolution No. 85-130, and the Bonde property. <br /> <br /> 2.5 To the extent any monies are received by way <br />of reimbursement as set forth in Section 2.4 above said <br />monies shall be distributed one-half to Lin and one-half to <br /> <br />City, for applicataion to circulation system improvements <br />made necessary by ongoing development. <br /> <br /> <br />
