as Parcel 3 in Exhibit "B" attached hereto and incorporated <br />herein by reference. <br /> <br /> 1.8 The Bernal Avenue "Loop", including the <br />Bernal/Bonde extension has been shown as part of the <br />circulation element of the City General Plan since 1958, and <br />is a listed but unfunded project in City's Capital <br />Improvement Program. <br /> <br /> 1.9 The Bernal/Bonde extension will require the <br />acquisition of right-of-way by City, some of which is over <br />land that is both subject to an agricultural land preserve <br />(Williamson Act Contract) and outside the current city <br />limits of Pleasanton, in Alameda CountI'. <br /> <br />1.10 Neither Lin nor City have been able to <br />negotiate the acquisition of the necessary right-of-way by <br /> <br />purchase and it has become necessary for the City to <br />exercise its right of eminent domain. <br /> <br /> ARTICLE II <br /> <br /> AGREEMENT <br /> <br /> 2.! City (through the North Pleasanton <br />Improvement District) agrees to purchase the Lin/West Las <br />Positas property at fair market value which amount is One <br />Million Dollars ($1,000,000).
