2.6 It is anticipated that funding will not <br /> become available for the acquisition of the Lin/West Las <br /> Positas property until the Fall of 1987. Accordingly, City <br /> agrees to fund initial costs and commence the Bernal/Bonde <br /> extension project provided that Lin will deposit as security <br /> a Letter of Credit in the amount of $1,000,000. <br /> <br /> 2.7 City agrees to adopt a plan line for the <br /> necessary right-of-way forthwith. Lin agrees to cause the <br /> preparation of the necessary construction drawings <br /> (including civil and soils engineering) for the project <br /> (Bernal/Bonde extension) and submit to City for review and <br /> approval. Lin or Lin's successor Ln interest, either <br /> directly or through third parties, ~Trees to build the <br /> project as an off site project in connection with the <br /> Lin/Kottinger Ranch development. All reasonable costs <br /> associate~ with the project pursuant to this paragraph will <br /> constitute project costs. <br /> <br /> 2.8 City agrees to initiate eminent domain <br />-proceedings; give notice to the Department of Conservation <br />to the extent necessary to cancel the Williamson Act <br />Contract on the Bonde property; and, take all other <br />appropriate and necessary actions to acquire the right-of- <br />way for the project.
