In response to question, staff indicated there was a concern for having afast-food <br />restaurant at this location. Council could delete the condition to prohibit fryers and <br />grills to provide for a future restaurant that is acceptable but it may pose problems <br />for a future fast-food restaurant going in. <br />Discussion ensued regarding what might happen if Pete's fell through and what <br />type of application might be considered for use in the future. Consideration of a <br />Fast Food Ordinance was suggested for discussion in the future. The City <br />Manager indicated to provide the maximum flexibility the Council may want to <br />strike the Planning Commissioin condition to prohibit fryers and grills because as <br />zoned the Council will have an opportunity to appeal it. <br />Mayor Hosterman opened the public hearing. <br />Aaron Epperson addressed the City Council representing Petter Shutts <br />Architecture, and urged Council's support of their PUD. <br />Motion: It was m/s by Cook-Kallio/Thorne, to introduce Ordinance No. 1948 <br />approving an application for a Planned Unit Development (PUD) major modification <br />and development plan to demolish an existing drive-through bank building and <br />related site improvements and construct an approximately 2,530-square-foot <br />one-story commercial building in its place at the property located at 5765 Valley <br />Avenue, with the following conditions 1) require a CUP for a fast food restaurant; 2) <br />remove the condition restricting the grille/fryer 3) delete use of the #4 (light green) <br />from the color palate. Motion carried by the following vote: <br />Ayes: Cook-Kallio, McGovern, Sullivan, Thorne, Mayor Hosterman <br />Noes: None <br />Absent: None <br />20. Public Hearing: PUD-60, Christopher Andrews/Darrell Scherbarth -Consider an <br />application for Planned Unit Development to demolish an existing <br />2,125-square-foot home and to subdivide the parcel into three lots to construct <br />three custom homes at the property located at 2500 Vineyard Avenue, within the <br />Vineyard Avenue Corridor Specific Plan Area <br />Donna Decker, Acting Director of Planning and Community Development gave the <br />staff report indicating the applicants propose a PUD Development Plan to allow the <br />construction of three custom homes. The proposed residences have individual <br />design, style, and a color form of a cohesive unit complementary to the Vineyard <br />Avenue Corridor Specific Plan. The applicants have agreed to the conditions of <br />approval as shown in Attachment 1, Draft Ordinance. Staff and the Planning <br />Commission believe that the project, as conditioned, is awell-executed design and <br />is complementary to the surrounding area. <br />City Council Minutes 14 March 20, 2007 <br />
