9. Approved plans and specifications, reviewed bids and awarded a contract to O'Grady <br />Paving Inc. in the amount of $1,691,789 for Vineyard Avenue Median Streetscape <br />Improvements, Project No. 055031; authorized the Director of Public Works to approve <br />and execute contract change orders for a contingency amount not-to-exceed $252,268.02; <br />authorized the transfers of $796,521 from the Annual Street Resurfacing CIP #065003 and <br />$46,086 from the Annual Street Re,~urfacing CIP #055003 -Hosterman abstained <br />Motion: It was m/s by Sullivan/McGovern to approve the Consent Calendar as <br />recommended and as noted. Motion passed by the following vote: <br />Ayes: Councilmember Cook-Kallio, McGovern, Sullivan, Thorne, Mayor Hosterman <br />Noes: None <br />Absent: None <br />MEETING OPEN TO THE PUBLIC <br />10. Presentation by Foothill High School Music Club and Tyler Cornfield of a donation for the <br />Bernal Property Teen Center <br />Tyler Cornfield made a presentation to the Bernal Property Teen Center of proceeds from <br />their concert for Alex Sutton and his family who were affected by hurricane Katrina. <br />Mr. Cornfield also commented on a new project started to raise funds for a friend whose <br />tank was blown up in Iraq which is called Operation I-Pod. They plan to work toward <br />getting I-Pods donated and filled with music to send to hospitals in Iraq where troops are <br />recovering. <br />11. Public Comment <br />Mike Duarte addressed the Council and congratulated both the boy's and girl's basketball <br />teams as they all made the playoffs this year. He thanked the Council for adopting the <br />staff's recommendation to have Congressman McNerney handle such a forum regarding <br />the war in Iraq. He commented on the letter adopted by the Council regarding their <br />disagreement with the Patriot Act, which he did not agree with. He added that there are <br />local issues that need to be dealt with by the Council that are not national issues. <br />Dan Carl addressed the Council regarding Mayor Hosterman. He noted that after four <br />months of review, the DA chose not to pursue legal action concerning the Mayor's use of <br />City resources. He urged the Council to take meaningful action on a code of ethics and to <br />hold itself to it. He suggested Council agendize a discussion on ethics in government and <br />to hold themselves to the same standards that they hold city employees. <br />City Attorney Roush noted the Council will be discussing an a-mail policy in the near <br />future. <br />Jack Bras addressed the Council suggesting that public hearing items be dealt with prior <br />to any presentations, photo opportunities and other time consuming items. <br />Fred Norman addressed the Council regarding his request to hold a moment of silence in <br />honor of troops killed in Iraq. <br />City Council Minutes 4 February 20, 2007 <br />
