2.6 Default. If City shall violate or shall <br />default in complying with any provision hereof which it is <br />bound to perform or keep, Land Owner shall give written <br />notice to City describing such violation or default. Within <br />thirty (30) days after the giving of such notice, City shall <br />fully remedy the same, or be in the process of diligently <br />remedying the default in good faith if same cannot reasonably <br />be fully cured within said thirty (30) days, and if City <br />fails to do so, Land Owner shall have the option to terminate <br />this Agreement by mailing notice to that effect to City and, <br />if Land Owner does terminate the Agreement, City's rights <br />(except for removal of its property) shall then cease. <br /> <br /> 2.7 Binding. Subject to the express provisions hereof, <br />this Agreement and each and every covenant thereof shall <br />inure to the benefit of and be binding upon the successors <br /> <br />and lawful assigns of the parties hereto, respectively. <br /> 3. compensation for Damaqe <br /> <br /> If any operations conducted by City in and upon the <br />Property pursuant to this Agreement shall directly cause any <br />damage to crops or other property belonging to Land Owner or <br />Land Owner's tenant, City shall reimburse Land Owner in a <br />reasonable amount on account of the loss actually occasioned <br />by such damage.
