Mr. Fialho said when the project is submitted for bid, the goal is to do it in such a way
that staff would be able to remove things or add things to try and be within the budget of $4.7
million, and if that amount is exceeded, he is prepared to return to Council with a
recommendation to find the sources to fund the project so that all of the needs are met.

Mayor Hosterman invited public comments.

Harinder Grewal, Chairperson of the Community Action Committee for the Walnut Hills
and Canyon Oaks developments, presented written communication to Council indicating that
these two communities are the ones most affected by any development on the Bernal property.
On behalf of these residents, he requested the following: (1) due to the lighting and the noise,
limit the time that the fields are in use; (2) divert traffic towards Bernal near the Pleasanton
Avenue intersection or to a connection at Case Avenue; and (3) include foliage that provides a
division between the fields and the future park/neighborhood.

Mayor Hosterman closed the public comments.

It was moved by Mr. Thorne, seconded by Mr. Sullivan, to adopt Resolution 05-
056, a resolution approving a Negative Declaration for the application of the City of
Pleasanton, for PUD Development Plan approval, as filed under Case PUD-46; to
determine that the Project would not have a significant impact on the environment with a
finding of "de minimus impact;" to introduce Ordinance 1921, an ordinance approving
the application of the City of Pleasanton for PUD Development Plan approval, as filed
under Case PUD-46; and directing staff to investigate permeable paving and shade
structures for the Bernal Community Park.

The roll call vote was taken as follows:
AYES: Councilmembers - McGovern, Sullivan, Thorne, and Mayor Hosterman
NOES: None
ABSENT: Councilmember Brozosky
ABSTAINED: None

6._~c
Weed Abatement Assessments for 2005 (SR 05:196)

Scott Deaver, Assistant Fire Marshall, presented the staff report.

Mayor Hosterman declared the public hearing open.
