always be consistent which will give the public faith that these are their courts. She wanted this
clearly defined when Council discussed this matter with the Parks and Recreation Commission.

Mr. Brozosky wondered if the schedule for courts could be made available to the public
electronically.

Mr. Gill said Lifetime Tennis, Inc., is affiliated with an online reservation service that can
provide access to the community. He noted that this was not proposed in the contract, as he
wanted to find out the real needs of the community. If the community was reaching out for
additional information and understanding as to what is accessible, Lifetime Tennis, Inc., would
offer this service.

Ms. McGovern referred to Section 8.03 of the contract which states that the City may
require Lifetime Tennis, inc., to submit audited financial statements for the operation of the
Facilities, including an independent certified public accountant's audit report and audit
management letter to City within ninety days after the end of each operating year. She asked if
the wording "may require" could be changed to "will require."

Mr. Wolfe pointed out that this section of the contract does not preclude an annual
statement. This section specifically states that it may be an audited financial statement. The
reason staff included the wording "may require" is because there is a cost associated with this
and unless the City is willing to absorb this cost, it might become difficult for the Tennis
Operator.

Ms. McGovern said she would like to require Lifetime Tennis, inc., to submit audited
financial statements for the first year. She was hoping that Council could ask the Parks and
Recreation Commission to access the current needs and quality of the public courts that are
currently available in Pleasanton. She wanted to include Pleasanton Middle School, Fairlands
and Muirwood Community Parks. She mentioned that she received a complaint regarding grass
growing on the newly renovated Pieasanton Middle School tennis court.

Mark Spiller, Community Services Manager, was not aware of grass growing on the
newly renovated court. He noted that there are deficiencies in the surtace work and the
contractor will be coming back to do the additional repairs as the court is still under warranty.

Mr. Wolfe believed the weeds and grass were adjacent to a field area. Staff has
discussed with the School District the ability to trim this back as it is starting to encroach through
the fence onto the tennis court.

Ms. McGovern also mentioned that she had received a complaint regarding the height of
the fence around the Pleasanton Middle School tennis court.

Mr. Wolfe believed the fence was standard size, but said staff would look into the matter.

Ms. McGovern asked if the Parks and Recreation Commission would hold hearings on
the option of installing court lighting at the two existing tennis courts at Pleasanton Middle
School?

Mr. Wolfe said yes.

Ms. McGovern mentioned the staff reported indicated that there are 15 total tennis
courts located at the high schools. She asked if all 15 of these courts could be used for drop-in
play?

Pleasanton City Council 18 05/17/05
Minutes
