She wanted this <br />clearly defined when Council discussed this matter with the Parks and Recreation Commission. <br /> <br /> Mr. Brozosky wondered if the schedule for courts could be made available to the public <br />electronically. <br /> <br /> Mr. Gill said Lifetime Tennis, Inc., is affiliated with an online reservation service that can <br />provide access to the community. He noted that this was not proposed in the contract, as he <br />wanted to find out the real needs of the community. If the community was reaching out for <br />additional information and understanding as to what is accessible, Lifetime Tennis, Inc., would <br />offer this service. <br /> <br /> Ms. McGovern referred to Section 8.03 of the contract which states that the City may <br />require Lifetime Tennis, inc., to submit audited financial statements for the operation of the <br />Facilities, including an independent certified public accountant's audit report and audit <br />management letter to City within ninety days after the end of each operating year. She asked if <br />the wording "may require" could be changed to "will require." <br /> <br /> Mr. Wolfe pointed out that this section of the contract does not preclude an annual <br />statement. This section specifically states that it may be an audited financial statement. The <br />reason staff included the wording "may require" is because there is a cost associated with this <br />and unless the City is willing to absorb this cost, it might become difficult for the Tennis <br />Operator. <br /> <br /> Ms. McGovern said she would like to require Lifetime Tennis, inc., to submit audited <br />financial statements for the first year. She was hoping that Council could ask the Parks and <br />Recreation Commission to access the current needs and quality of the public courts that are <br />currently available in Pleasanton. She wanted to include Pleasanton Middle School, Fairlands <br />and Muirwood Community Parks. She mentioned that she received a complaint regarding grass <br />growing on the newly renovated Pieasanton Middle School tennis court. <br /> <br /> Mark Spiller, Community Services Manager, was not aware of grass growing on the <br />newly renovated court. He noted that there are deficiencies in the surtace work and the <br />contractor will be coming back to do the additional repairs as the court is still under warranty. <br /> <br /> Mr. Wolfe believed the weeds and grass were adjacent to a field area. Staff has <br />discussed with the School District the ability to trim this back as it is starting to encroach through <br />the fence onto the tennis court. <br /> <br /> Ms. McGovern also mentioned that she had received a complaint regarding the height of <br /> the fence around the Pleasanton Middle School tennis court. <br /> <br /> Mr. Wolfe believed the fence was standard size, but said staff would look into the matter. <br /> <br /> Ms. McGovern asked if the Parks and Recreation Commission would hold hearings on <br /> the option of installing court lighting at the two existing tennis courts at Pleasanton Middle <br /> School? <br /> <br /> Mr. Wolfe said yes. <br /> <br /> Ms. McGovern mentioned the staff reported indicated that there are 15 total tennis <br /> courts located at the high schools.
