incorporate some of the Conditions of Approval that were applied to Fernando's <br />Restaurant, particularly the outdoor dining limitation of 10 p.m. She believed Council <br />needed to consider the proposed live entertainment, as it will generate loud noise. She <br />suggested acoustical music and adding a condition that eliminates electronic <br />enhancement music and a dance floor. She did not believe live entertainment would <br />work in this location for very long, <br /> <br /> Howard Neely, a Pleasanton resident, believed the proposed project is good for <br />the downtown. He believed the City needed to think about a master plan and adequate <br />parking for the downtown. <br /> <br /> Michael O'Callaghan, representing the Pleasanton Downtown Association, <br />supported the approval of the Conditional Use Permit. He noted that the Pleasanton <br />Downtown Association supports having a quality, vibrant, later evening establishment to <br />frequent. He did not believe Council should over regulate this business. <br /> <br /> In response to an inquiry by Mr. O'Callaghan, Mr. Roush said that Toby's <br />Conditional Use Permit was revoked at the Planning Commission level and was <br />appealed. Before the matter was presented to Council, the appellant closed the <br />business so it became academic at the Council level. <br /> <br /> Mr. O'Callaghan encouraged Council to support the Pleasanton Downtown <br />Association, its Specific Plan and City staff and allow Ms. Kennard to operate her <br />business until it becomes a problem. <br /> <br /> Mr. Sauter said he and his wife were not opposed to a restaurant and a <br />restaurant that serves alcohol. They are opposed to a restaurant that is so close to a <br />residential area and a restaurant that serves alcohol late at night with the addition of live <br />music. <br /> <br /> The following Pleasanton residents provided written communication to Council in <br />opposition to the Planning Commission's approval of an application for a Conditional <br />Use Permit to serve beer, wine, and spirits after 10:00 p.m. for the Oddfellows British <br />Pub and Restaurant located at 336 St. Mary Street: Frances Stone, Steve and Rachel <br />Banke, Liz Ray, Sylvia Hagen, and Jan Villott. <br /> <br /> The following Pleasanton residents provided written communication to Council in <br />support of the Planning Commission's approval of an application for a Conditional Use <br />Permit to serve beer, wine, and spirits after 10:00 p.m. for the Oddfellows British Pub <br />and Restaurant located at 336 St. Mary Street: Gordon Corsie, Klm Turpin, Janine <br />Edwards, and Kathy Lorenz. <br /> <br /> David Bouchard, President & CEO of the Pleasanton Chamber of Commeme, <br />provided written communication to Council in support of the use proposed for the <br />building located at 336 St. Mary Street. The Chamber supports the proposed use <br />because it promotes local commerce, increases sales tax and other revenues, and <br />enhances the economic and job environment.
