Written communication was presented to Council from various Pleasanton <br />residents expressing their viewpoints to two questions: (1) should the vitality of the <br />downtown's business district extend farther into the evening, and (2) should the Council <br />support the Oddfeliows British Pub and Restaurant's hours and conditions of operation <br />as already approved by the Planning Commission. <br /> <br /> Mayor Hosterman closed the public hearing. <br /> <br /> It was moved by Mayor Hoaterman, seconded by Mr. Brozosky, to adopt <br />Resolution 05-008, a resolution denying the appeal and, therefore, approving Case <br />PCUP-129, subject to the conditions listed in the Planning Commission Resolution <br />No. PC-2004-69, with modification of Condition 2 as indicated in the memorandum <br />to the staff report, and to make the Conditional Use Permit findings as listed on <br />pages eight and nine of the attached Planning Commission staff report. <br /> <br /> Mr. Brozosky supported the proposed use and said he would like to see more <br />variety of eating establishments in the downtown. He noted that the Union Jack Pub is <br />an existing problem and the Planning Commission will be addressing it shortly. He did <br />not want to deny other proposed uses because of the existing problems at the Union <br />Jack Pub. He pointed out that the downtown belongs to the entire City. The City is <br />responsible for monitoring and keeping the downtown safe and needs to make sure the <br />adjacent uses are compatible. <br /> <br /> Ms. McGovern mentioned that she visited the building, which needs to be <br />renovated. She believed this building brings something back to the downtown, which <br />invites a class establishment to want to be located there. She noted that this building is <br />not large in size. Because of the size of the building, the amount of mitigation that can <br />be done, the fact that people are eating in close proximity to the music, and the relatively <br />small dance floor, she believed this could be an establishment that young people would <br />like to frequent. She supports people who live in town and want to open a business in <br />this community. <br /> <br /> As a previous Planning Commissioner, Mr. Sullivan said he supported the <br />renovation of the building, which was independent of this application. He supports the <br />use that is being proposed and believes it will be an asset to the downtown. He believed <br />it is incumbent on downtown businesses to adjust their expectations and to try and <br />coexist with their neighbors, particularly when the businesses are on the fringes of the <br />business district adjacent to the neighborhoods. He supported the proposal but wanted <br />to see if there was any interest in adjusting the hours of operation, particularly on the <br />weekdays to make it make conducive to a residential neighborhood. He did not believe <br />it was unreasonable to ask the establishment to close at 10 p.m. on the weekdays and <br />close at midnight or I a.m. on the weekends as long as the outdoor activities are limited <br />to lOor 11 p.m. <br /> <br /> Mayor Hosterman said would not support adjusting the hours of operation <br />because she believed the Planning Commission did an adequate job of working through <br />this particular project. She complimented staff for an outstanding job in working with <br />both the applicant and the appellants in trying to balance and meet the needs of both <br />parties. For the owner of this business to go forward with the major renovations to this <br />building, she needs to be able to count on a certain amount of income derived from that <br />new business, particularly if the applicant is able to stay within the parameters of all of <br /> <br />Pleasanton City Council 19 02/01/05 <br />Minutes <br /> <br /> <br />
