6. PUBLIC HEARINGS AND OTHER MATTERS <br /> <br />Item 6a <br />PAP-50, Appellant: Jennifer Hosterman (PDR-338~ Wal-Mart Stores). (SR 04:226) <br />Appeal of the Planning Commission's approval of the application of Wal-Mart <br />Stores for design review approval to construct an approximately $,264-square-foot <br /> <br />stockroom addition and an approximately 5,761-square-foot garden center <br />expansion to the existing Wal-Mart store located at 4501 Rosewood Drive in the <br />Metro 580 shopping center. Zoning for the property is PUD-I/C-O (Planned Unit <br />Development - Industrial/Commercial-Office) District. <br /> <br /> Brian Swift, Director of Planning and Community Development, presented the <br />staff report. <br /> <br /> Mr. Brozosky asked staff if Wal-Mart had certain vested rights on how much it <br />could expand in its current location? <br /> <br /> Mr. Swift said the original approval had a 30,000 square-foot area that could be <br />added on to the building, towards Rosewood Drive. The 5,264-square-foot stockroom <br />expansion would be constructed on a portion of the site currently paved as a parking lot <br />on the south side of the existing store and adjacent to the existing stockroom area at the <br />back of the store. Like most of the properties in the Hacienda Business Park, this <br />property is governed by a development agreement; therefore, this property is fully <br />vested. The City is allowed design review approval over this part of the application, <br />which is why the Planning Commission asked the applicant to redesign the building and <br />come back with a different plan. He pointed out that Council's review is limited to the <br />design for this lot and a new traffic study could not be requested, as the issues have <br />been resolved with the original approval of this development and other developments in <br />the Hacienda Business Park. <br /> <br /> Ms. Ayala believed the Hacienda Owners Association had talked with Wal-Mart <br />about addressing its storage area for Christmas supplies. <br /> <br /> Mr. Swift was not sure that the Hacienda Owners Association discussed this <br />matter with Wal-Mart. Wal-Mart has routinely asked staff if it may park trailers in the rear <br />of the store for temporary inventory storage. This request was not approved in the <br />original approval and staff has not been able to support this request. WaI-Mart's request <br />for this expansion is for a storage stockroom area that will be located inside the building <br />so that it may hold additional inventory all year. <br /> <br /> Ms. Hosterman noted that the 30,000-foot expansion is relatively small. She <br />asked if it would make an overall difference to require an additional traffic study if Wal- <br />Mart were to expand its store site to 30,000 additional square feet or more, which would <br />identify what the impacts would be to this area? <br /> <br /> Because of the original approval and the conditions of approval that govern this <br />property and many of the other properties that were owned by Prudential in the early <br />1990's, Mr. Swift said that as long as the expansion proceeds within the square footage <br />that was allowed, no new traffic study is required. The 30,000 square feet that was <br />approved for this building can be built without a traffic study.
