Businesses have left the <br />shopping center area because of the lack of property maintenance. He indicated he would <br />like to explore the possibility of using eminent domain to acquire the property. <br /> <br />Mayor Pico said any discussion of eminent domain is taking the discussion off track. The <br />City does not have this type of authority without the creation of a redevelopment agency, <br />which the City has voted down. <br /> <br />Mr. Roush said that is correct. Eminent domain can only be exercised for a public use. <br />A redevelopment agency can condemn a property for redevelopment purposes. <br /> <br />Councilmember Brozosky said in the Western Cities magazine there was an article <br />suggesting some cities using eminent domain for shopping centers that had been blighted. <br />The property was sold to a developer and allowed to continue as a commemial venture. <br /> <br />Mr. Roush said he would look into this further. There is a property maintenance <br />ordinance for the purpose of keeping properties that are not properly maintained kept to <br />City standards. If a property owner does not comply with these standards the City has <br />the option of cleaning up the property and puffing a lien on the parcel to recover the costs <br />incurred. The procedure is to have the Code Enforcement Officer look at the property <br />and determine whether or not the property maintenance ordinance would apply. Another <br />approach is to have the Building Department investigate to see whether there is some <br />enforcement mechanism under the Uniform Codes. <br /> <br />Mr. Swift said a Code Enforcement Officer has been at the location many times. It gets <br />cleaned up and then deteriorates rapidly; it is an ongoing problem. <br /> <br />Councilmember Ayala said it is the City's strong desire to bring this property up to par. <br />It would certainly be a showing of goodwill towards the City and Council to do that, <br />especially if they are asking for special circumstances. <br /> <br />Mr. Tong said the quicker the process can go forward the quicker it can be resolved. <br /> <br />Connie Goldade, 5142 Franklin Drive, representing McKay and Somps, and speaking on <br />behalf of the Vintage Hills Shopping Center, said she expects the traffic study to be done <br />on the project within 3 - 4 weeks. This will look at the project that is proposed versus <br />what is there now versus what could be there other than commercial property. They have <br />completed a parking demand study for affordable senior housing at six different projects <br />in the Bay Area, two of which are in Pleasanton. Based on those numbers, the project <br />would provide more than the needed amount for parking for senior projects. Regarding <br />the concern about the social services impacts, this project is providing over 5,000 square <br />feet of senior amenities. This is based on the City's draft senior amenity program.
