Mr. Swift said that the applicant would not be required to pay traffic impact fees <br />since this building has already been constructed. Traffic impact fees are only required for <br />new construction projects. <br /> <br /> It was moved by Mr. Brozosky, seconded by Mr. Campbell, making the <br />Conditional Use Permit findings as listed on pages 5-6 of the Planning Commission <br />staff report and adopting Resolution No. 04-046, a resolution approving the appeal <br />and, therefore, approving Case PCUP-109, subject to the conditions as listed in <br />Exhibit B. <br /> <br />The roll call vote was as follows: <br />AYES: Councilmembers- Ayala, Brozosky, Campbell, Hosterman, and <br /> <br /> Mayor Pico <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br /> Mayor Pico deferred to Lynn Tracy Nerland, Assistant City Attorney, for a report <br />on the Closed Session that was held prior to the commencement of the Council meeting. <br /> <br /> Ms. Tracy Nerland stated that the City Council met in Closed Session regarding <br />pending litigation with Signature Properties et ai.v. Pleasanton Unified School District. <br />She noted that Mr. Brozosky was not present due to a conflict of interest. The Council <br />received an update and no action was taken. With respect to the conference with legal <br />counsel concerning the claim of Farmers Insurance, action was taken, which passed <br />unanimously with ail councilmembers present. Staff was directed to settle the matter <br />according to staff's recommendation. A third issue was raised as an urgency item. Under <br />the real property negotiation exception for the Brown Act, a motion was made by Mr. <br />Campbell and seconded by Ms. Hosterman, and with three aye votes, the motion failed <br />the four-fifths requirement for an urgency item to be placed on the agenda. Therefore, <br />the matter regarding the disposition of 4242 Vervais Avenue was not considered. <br /> <br />PAP-63~ Appellant: Jennifer Hosterman (PSDR-182)~ Mike Szeredy/People Soft <br />(SR 04:140) <br />Appeal of the Planning Commission's denial of the appeal of the Zo~alno <br />Administrator's approval of an application for si~n dc~i~_n review to ch~n~e the <br />wording of the existing monument sign facing 1-580 from "Hacienda" to <br />"PeopleSoft" and to modify the sign.
