It was moved by Mr. Brozosky, seconded by Ms. Ayala, to adopt Resolution <br />No. 04-047, a resolution denying the appeal of Case PAP-63, thereby approving the <br />application of l~ike Szeredy/PeopleSoft, for sign design review approval, as filed <br />under Case PSDR-182 subject to the conditions as shown in Exhibit B. <br /> <br />The roll call vote was as follows: <br />AYES: Councilmembers- Ayala, Brozosky, Campbell, Hosterman, and <br /> <br /> Mayor Pico <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br />6d <br />PAP-65~ Appellant: Kay Ayala~ (PMS-27~ Tony Perino/Nearon Enterprise, <br />(SR 04:143) <br />Appeal of the Zoning Administrator's approval of an application to subdivide an <br />approximately 10.5-acre parcel into two lots m~nsuring approximately 5.5 acres and <br />5.0 acres, respectively. The property is located at 5725 West Las Positas Boulevard <br />and is zoned PUD-I/C-O (Planned Unit Development - Industrial/Commercial- <br />Office) District. <br /> <br />Mr. Swift presented the staff report. <br /> <br /> By taking the action to deny the appeal and upholding the approval of this matter <br />subject to the conditions of approval, Mayor Pico did not want to prohibit future <br />referenda or citizen action on the uses that might occur on this property. <br /> <br /> Mr. Swift said that the exact same opportunities exist for this property without it <br />being subdivided. <br /> <br /> Mayor Pico asked if the right for a referendum still exists for this property, or is <br />this property limited under the Hacienda Business Park Development Agreement? <br /> <br /> Mr. Swift said this site is no longer covered under the Hacienda Business Park <br />Development Agreement. <br /> <br /> Mayor Pico asked if any future actions for a General Plan amendment, rezoning <br />or other uses would be subject to referendum if there were action taken by Council that <br />the citizens did not agree with'? <br /> <br /> Mr. Swift said that these types of changes would be subject to referendum even if <br />this property were still covered under the Hacienda Business Park Development <br />Agreement. <br /> <br /> Ms. Ayala concurred with Mayor Pico's concerns. She stated that she had <br />appealed this matter at the request of one of the Verona property owners.
