He noted that one of the <br />creeks runs behind the Nearon Enterprises' property. <br /> <br /> In response to an inquiry by Ms. Ayala, Mr. Swift noted that Valley Care has an <br />option to purchase this property but it may not purchase the property until the minor <br />subdivision is approved and a parcel map is recorded. <br /> <br /> Ms. Ayala asked if everyone was aware of the problems that are occurring in the <br />Verona area? <br /> <br /> Mr. Swift believed that the pumhasers of both lots would be aware of what has <br />happened in various sites within the Hacienda Business Park. <br /> <br /> Ms. Ayala was aware that there were subsidence problems in the Verona area <br />which was why she was concerned when the Verona property owner had brought it to <br />Council's attention. <br /> <br /> Ms. Tracy Nerland clarified that this subdivision has no effect on what could be <br />subject to a referendum. A legislative action by the Council is subjective to a referendum <br />(zoning change, General Plan amendment, and PUD), but an adjudicated action (use <br />permit) is not subject to a referendum under California law. <br /> <br />Mayor Pico declared the public heating open. <br /> <br /> Tony Perino, 500 La G onda Way, Suite 210, Danville, owner/applicant, informed <br />Council that Nearon Enterprises purchased the office building and the extra land from <br />Hewlett Packard four years ago. At the time Nearon Enterprises purchased the building, <br />Hewlett Packard was still a tenant, as was the University of Phoenix. Several years later, <br />Nearon Enterprises entered into lease negotiations with Valley Care to lease the property, <br />as Valley Care was looking for additional space as part of the hospital's expansion plans. <br />The lease agreement that Nearon Enterprises entered into with Valley Care was a long- <br />term agreement for the entire building. A provision was included in the long-term lease <br />agreement that provided Valley Care an option to purchase the building, and one year <br />after the lease agreement commenced, Valley Care exercised its option to purchase the <br />building. He pointed out that Valley Care is only purchasing one parcel. The long-term <br />lease agreement does not cover the extra five acres, and a condition of the sale was that <br />Nearon Enterprises would have to subdivide the property into two parcels. Nearon <br />Enterprises began working with staff to develop a parcel map so that there would be two <br />legal parcels. One legal parcel will be for the building that Valley Care currently leases <br />and will own, and the remaining parcel will be a five-acre parcel that Nearon Enterprises <br />will continue to own and hold for future development opportunity.
