Ms. Hosterman pointed out that the PEC is currently comprised of 18 members
and they might be satisfied with that number.

Mayor Pico said that each councilmember appointed a member to the PEC. He
believed it was appropriate for councilmembers, who originally appointed a member, to
be able to appoint a replacement.

The roll call vote was taken as follows:
AYES: Councllmembers - Ayala, Brozosky, Campbell, Hosterman, and

Mayor Pico
NOES: None
ABSENT: None
ABSTAIN: None

6__f
Clean Air Plan for the Tri-Valley Area. (SR 04:077)

Ms. MeKeehan noted that staff's suggestion was to review the Clean Air Plan for
the Tri-Valley Area as part of the General Plan update, unless Council wanted to review
it sooner.

It was moved by Ms. Hosterman, seconded by Mr. Campbell, to refer the
Tri-Valley Clean Air Plan to staff for its review and incorporation into the General
Plan update process.

The roll call vote was taken as follows:
AYES: Councllmembers - Ayala, Brozosky, Campbell, Hosterman, and

Mayor Pieo
NOES: None
ABSENT: None
ABSTAIN: None

7. MATTERS INITIATED BY COUNCIL

Mr. Brozosky was concerned about existing litigation and potential new litigation
with Signature Properties.

Mr. Roush said that the closed session items, as listed on the agenda, do indicate
that the City has potential litigation involving Signature Properties concerning a number
of items regarding the Vineyard Avenue Roadway, PUD conditions and acceptance of
public improvements within the Ruby Hill subdivision. He believed there was sufficient
information provided that warranted listing this as a closed session item for Council to
discuss.

Pleasanton City Council 22
Minutes

04/06/04
