Mr. Grubstick said yes.

Mr. Brozosky asked if the Engineer had paid for the errors?

Mr, Crcubstick noted that staffhad not yet discussed the design errors with the
Engineer. Staffwanted to make sure it captured everyth'mg that is included in the project
before it starts the negotiation process with the design consultants.

Ms. McKeehan pointed out that the City has received a number of claims that it is
not necessarily accepting.

Mr. Brozosky asked how significant were the claims?

Mr. Wilson pointed out the sensitivity of this issue, and mentioned that these
issues that will be subject to further negotiations.

Mr. Brozosky referred to line item 23 which pertained to the sanitary sewer lift
station on Alisal Street. This lift station was originally planned to be above ground, and
the County has now required the facility to be underground to be less intrusive. He asked
if this type of facility would typically be located underground in the City?

Mr. Wilson mentioned that the original standard design for a City sanitary sewer
lift station is above ground. If the annexation had been approved, the street would have
been in located in Pleasanton and the above ground station would have been acceptable to
the City of Pleasanton. During its review, the County required that the lift station be
placed underground, which resulted in a fairly significant cost to the project. He noted
that it is much more expensive to place electrical equipment below ground than above
ground.

Mr. Brozosky referred to line item 33 which related to the Clubhouse site plan
revision. He asked if the additional costs were due to the specifications not being
adequate in the early stages, or where there significant changes to the Clubhouse that
increased the cost?

Mr. Wilson indicated that this Change Order included items for the Clubhouse
that had not been originally designed at the time the project was awarded. Once the
Clubhouse was located and staffknew where the utilities would be located, staff asked
for a price quote from Ferma Construction and added these new items.

As part of this proposal, Mr. Brozosky pointed out that staffis recommending
approval of $1.7 million dollars in Change Orders. He asked why staffexpected the need
for another $1.7 million dollars?

Mr. Wilson mentioned that the $1.7 million dollars would increase the originally
approved contingency, plus provide a small contingency for possible future claims.

Pleasanton City Council 13 02/03/04
Minutes
