Ms. Ayala realized the original CC & R's had expired, but inquired as to whether <br />or not the original CC & R's mandated the development be single story, to which Mr. <br />Swift confirmed as correct. <br /> <br /> Ms. Ayala would prefer this option. She would prefer the neighbors first pursue <br />this with the renewal ofthelr CC & R's. She asked if this is possible. <br /> <br /> Mr. Swift indicated that it is possible and would be a function of how the CC & <br />R's are structured. He pointed out that there is no homeowners association. Almost <br />always, a very large super majority is required to amend CC & R's, with as much as 90 to <br />95 percent needed. <br /> <br /> As the City is approaching build out, Ms. Ayala felt that this would affect the <br />older neighborhoods. Before Council revisits this issue, she would be interested in seeing <br />what would happen in that neighborhood if they tried to get a super majority to amend the <br />CC & R's. <br /> <br /> Mr. Campbell concurred with Ms. Ayala's comments particularly because of the <br />price of housing in Pleasanton. He asked if it were possible to incorporate this into the <br />General Plan Update review. <br /> <br /> Mr. Swift indicated that additions within existing neighborhoods is akeady on the <br />Council's list of issues and would be discussed at the General Plan review. <br /> <br /> Ms. Ayala wondered if it would be more expedient for the neighborhood to renew <br />their CC & R's mandating single story residential homes only. <br /> <br /> Mr. SWIt'~ was not sure that renewing the CC & R's would be more expedient but <br />noted that if they were to accomplish that, they would have their own rules that could be <br />enforced independent of the city zoning. Therefore, the City zoning requirements would <br />not necessarily have to change. <br /> <br /> Mayor Pico saw some difficulties with that eppmach as he thought the residents <br />would have to get 100 percent agreement before they could place a restriction on <br />someone else's property without any specific City action. He reminded Council that <br />when they last acted on this application there was a split vote. It was his personal belief <br />that if the neighborhood wanted to see a rezoning, it would have to come from the <br />neighborhood. They would need to petition the City Council with a sufficient number of <br />signatures that indicate the neighborhood is in support of the process, which is similar to <br />the process that occurs for traffic calming. He was not inclined to initiate a rezoning <br />unless there is significant support from the vast majority of the neighborhood, at least <br />two-thirds. <br /> <br /> Daniella Karo, 6578 Stanton Court, personally thanked Couneilmembers Ayala <br />and Brozosky for coming over, at her suggestion, to become more familiar with the issue. <br />She thanked Mayor Pico for following up with her communication.
