It was moved by Ms. Ayala, seconded by Mr. Brozosky, to introduce <br />Ordinance 1881, approving the application of New Cities Development Group for a <br />major modification to an approved Planned Unit Development, as filed under Case <br />PUD-97-12-3M. <br /> <br />The roll call vote was as follows: <br />AYES: Councilmember Ayala, Brozosky and Vice Mayor Campbell <br />NOES: Councilmember Hosterman <br />ABSENT: Mayor Pico <br />ABSTAIN: None <br /> <br />Item 6d <br />Activation of the Eastbound 1-580 On Ramp Traffic Metering System during the <br />peak evening commute hours (SR 03:073 Supplemental) <br /> <br />Jeff Knowles presented the staff report. <br /> <br /> Mr. Campbell asked if once the lights are tumed on and the City then decided it <br />wanted them turned off, what sort of leverage does the City have? <br /> <br /> Mr. Knowles replied that the City has requested a nine month period to fine rune <br />the system, and to do flyer information about the metering and possible re-routing. This <br />is built into the resolution and within the Agreement for cooperative management of the <br />1-580 Corridor. The City would have the ability, if we felt that we had specific problems, <br />to require Caltrans to shift to metering on demand or going solid green. It is in Caltrans <br />interest to make the system work in Pleasanton because it would like to expand it to the <br />rest of the corridor. <br /> <br /> Ms. Ayala said the agreement was longer than for nine months and could we have <br />it adjusted at any time. <br /> <br /> Mr. Knowles said nine months was given for staffto implement and fine tune the <br />system. If any major problems develop that can't be resolved, Council can change the <br />metering status. <br /> <br /> Ms. Ayala asked if the City of Pleasanton would in fact be able to change the <br />metering? <br /> <br /> Mr. Roush said that if the Council determined it wanted to have the lights <br />changed because they were not working as proposed, Council would give that direction to <br />staff and they would have the conversations with Caltrans. If Caltrans were unresponsive <br />to the request, the City would have to go to court and seek to have the contract enforced. <br />This is where the parties would get into what these different terms mean. It seemed clear <br />on its face that the City has the right to say if it does not work, then the lights would go to <br />the all green status.
